About this opportunity

The Delaware Department of Transportation is seeking bids on an open-end bituminous patching contract for Sussex County's South District covering fiscal years 2027–2029 (Contract T202606601), with bids due October 27, 2026 at 2:00 p.m. and an anticipated Notice to Proceed on or about December 21, 2026.

The scope encompasses labor and materials for bituminous patching of Delaware roadways via saw cutting, milling, paving, crack and joint sealing, pavement marking replacement, and drainage and utility adjustments. Work locations are assigned via work orders issued by the South District Maintenance Support office as funding becomes available, with individual work order completion timeframes of seven to fourteen calendar days. Estimated quantities include 6,800 tons of Superpave Type C patching material, 1,000 tons of Superpave Type B patching material, 140,000 square yard-inches of pavement milling, 8,000 linear feet of saw cutting, and 70,000 linear feet of permanent pavement striping. All patching must be performed at full lane width minimum using milling machines and pavers, with paving completed within seven days of milling and final markings within fourteen days of paving. Contractors must maintain an ATSSA-certified traffic control supervisor at each location and comply with Delaware Department of Transportation Standard Specifications (January 2026) and Standard Construction Details. The contract term is 1,095 calendar days. Work orders constitute the Notice to Proceed, and contractors must begin work within ten calendar days of issuance.

Prevailing wage requirements apply based on Sussex County rates as of September 25, 2026, with flaggers bid at minimum equal to the Laborer rate ($52.49/hour) and up to three times that rate. All contractors and subcontractors must register with the Delaware Department of Labor prior to performing work. Mandatory drug testing programs compliant with 29 Del.C. 6908(a)(6) are required. Bidders must submit a surety bond or security deposit equal to at least 10% of the bid amount and register with DelDOT through SimpliGov. A Performance-Based Rating System applies; contractors with ratings of 85% or higher may bid without retainage, while those below 85% may bid only if they execute an Agreement to Accept Retainage. Bids may be submitted via bidx.com/de or as paper bids to the DelDOT Administration Building in Dover. Questions are due no less than six business days prior to the bid opening date, directed to dot-ask@delaware.gov. The contract includes special provisions for asphalt cement cost adjustment, diesel fuel cost price adjustment (bidders must elect participation via signed form at bid opening or decline by default), nighttime paving surcharges, and electronic ticketing. Bid opening will be held in Dover with telephonic access at (302) 504-8986, meeting number 651 529 280#. No pre-bid meeting is scheduled.
