About this opportunity

The Maryland Office of People's Counsel is requesting proposals for expert consulting and testimony services to support its representation of residential and noncommercial interests in Hagerstown's electric base rate case (Case No. 9908) before the Maryland Public Service Commission, with proposals due October 30, 2026 at 5:00 p.m. EST.

The scope encompasses review of Hagerstown's filing materials, testimony, exhibits, workpapers, and discovery responses; issue identification and discovery assistance; development of recommended adjustments and policy positions; preparation of testimony and exhibits; review of rebuttal or surrebuttal testimony; hearing preparation support; assistance with settlement discussions and briefing; and technical analysis to support OPC's public communications regarding the case. OPC's expanded mandate under 2021 legislation requires consultants to consider environmental interests of the State and its residents, including progress toward Maryland's greenhouse gas emissions reduction goals.

Selected contractors must be registered and licensed to conduct business in Maryland with active registration in good standing, and must sign State affidavits regarding campaign contributions, drug policy, tax payment, debarment, and discrimination compliance. All work products, testimony, exhibits, reports, and related materials become the sole property of OPC with unrestricted use rights. Personnel identified in the proposal must remain assigned to the OPC account for the contract term unless no longer employed. Compensation shall not exceed a specified maximum amount covering labor and expenses. Travel and out-of-pocket expenses must conform to Maryland state travel regulations. The State retains the unilateral right to extend the contract term for up to three additional successive one-year calendar terms.

Evaluation will be weighted 40% Technical Expertise, 40% Quality of Issue or Policy Identification, and 20% Price. Proposals must be submitted on firm letterhead, signed by an officer, partner, or proprietor, and emailed to OPC.RFP1@maryland.gov. The Office reserves the right to cancel the solicitation, reject any or all proposals, waive minor irregularities, conduct discussions with qualified offerors, or award based solely on written proposals without negotiations.
