About this opportunity

Nebo School District, Purchasing Department has published a notice of intent to award a contract without engaging in a standard procurement process under Utah Procurement Code NSDSS26-0701, with a public challenge period closing July 21, 2026. The procurement is for a school book depository; the district claims sole source or transitional-cost justification for non-competitive award.

The Conducting Procurement Unit's detailed justification is contained in attached files and must be reviewed to establish whether the award meets Utah Procurement Code criteria — specifically, that only one source exists for the procurement item, that transitional costs are a significant consideration, or that circumstances make standard procurement impractical and not in the best interest of the district. The district has filed a textbook adoption policy document for the Mountain States region, which establishes standardized evaluation and selection procedures for textbook acquisition across the region.

Vendors may challenge the sole-source determination during the public notice period by submitting detailed documentation demonstrating the availability of competing sources, comparable or superior products meeting or exceeding specifications, or cost comparisons if transitional costs justify the award. Any challenge must include the contesting vendor's name and detailed explanation with supporting documentation.

The Division of Purchasing will make a written determination on the sole-source justification. If no valid challenges are received, the district may proceed with the non-competitive award. If other interested and qualified vendors are identified during the notice period, the Department may reconsider the award unless the basis is transitional costs or impracticability.

All responding vendors must certify compliance with Utah Code 63G-27 et seq., including certification that they are not engaged in economic boycotts or boycotts of the State of Israel and agree not to engage in such boycotts during the contract term. The notice indicates that additional funding may be added to awarded contracts if supplemental legislative appropriations are provided.
