About this opportunity
The Texas Department of Licensing and Regulation (TDLR), on behalf of the Texas Lottery Program, is conducting an Invitation for Bids (IFB No. RQ26-12110) for the procurement of three identical Daily 4 Drawing Machines and forty Daily 4 Ball Sets. The drawing machines must meet precise technical specifications, including four separate mixing chambers, transparent delivery tubes, dual operation modes (remote control and manual), three operational modes (automatic, semi-automatic, and interactive/manual selection), a height of 59 inches, ball-drawing capability in one second or less, swivel casters, water-resistant covers, and 25-foot power cords. The ball sets consist of ten numbered balls (0-9) per set with ping-pong style construction, weight certifications between 2.6-2.8 grams with variance not exceeding 0.095 grams, non-reflective coating, and security coding, with all sets requiring independent laboratory weight certification and delivery in lockable briefcase-style cases. The successful bidder must deliver equipment within 120 calendar days following purchase order issuance, provide on-site training and testing assistance for at least three business days, and supply a one-year warranty covering preventive maintenance, repairs, and emergency services with 48-hour emergency response capability. Pricing must be submitted on a Cost Sheet (Attachment D) on an F.O.B. Destination basis with all shipping and ancillary charges included. The evaluation criteria allocate 300 points for price, 300 points for probable quality of goods and services, 250 points for past performance, 100 points for bidder experience, and 50 points for personnel qualifications, totaling 1,000 points. Written technical questions are due February 27, 2026, at 4:00 p.m. Central Time, with responses posted by March 6, 2026; bid submissions are due March 16, 2026, by 3:00 p.m. Central Time via email to Procurement@lottery.state.tx.us, with award announcement anticipated by March 30, 2026.
This procurement includes a Historically Underutilized Business (HUB) participation goal of 21.10%, requiring all bids to include a completed HUB Subcontracting Plan demonstrating good faith effort to meet this target, with identified subcontracting opportunities in plywood crates and transportation/shipping services. The procurement is designated as proprietary/sole-source, as the equipment can only be purchased through its manufacturer, which restricts competition to the original equipment manufacturer. Amendment No. 1 to the IFB incorporates HUB Program rules promulgated by the Comptroller of Public Accounts under 34 Texas Administrative Code Sections 20.281-20.298, including Emergency Rules effective December 2, 2025, requiring bidders to certify compliance upon submission. All bidders must also certify compliance with Texas Government Code Section 466.155 regarding prohibitions on lottery-related contracts for ineligible persons. Liquidated damages are assessed at $250 per day for failure to deliver by the due date or failure to meet specifications causing late acceptance, and $100 per day for late emergency service response. The bid tenure is 90 days from the submission deadline, and no specific award value or budget range is disclosed in the procurement documents, though pricing must be submitted as part of the evaluation process.
