About this opportunity

The Missouri Department of Transportation (MoDOT), specifically the Southeast District, is conducting a Single Feasible Source (SFS) procurement for McCain ATC eX2 NEMA Traffic Signal Controllers with EPAC DB37 D Module. The solicitation identifies Pinkley Sales Company as the sole authorized distributor for McCain Traffic Products in Missouri, capable of providing these specialized controllers along with associated service, warranty, and repairs. These controllers are required for routine and emergency replacements at over 1,200 intersections that demand the unique functions of the eX2 model, which must be compatible with existing software and programming systems. The procurement is structured as a single feasible source solicitation, allowing MoDOT to waive competitive bidding due to the proprietary nature of the equipment. The solicitation period runs from July 24, 2024, to July 31, 2024, with electronic responses to be submitted through the MissouriBUYS eProcurement system. Evaluation criteria will focus on the lowest and best bid that meets all mandatory requirements, with MoDOT reserving the right to reject any and all bids.

The solicitation includes encouragement for minority and women-owned business enterprise participation, specifically targeting 10% Minority Business Enterprise (MBE) and 5% Women Business Enterprise (WBE) involvement through subcontractors, suppliers, or joint ventures. For commodity purchases exceeding $25,000, the Domestic Products Procurement Act provisions apply, offering a 10% price preference for American-made products. The delivery terms are specified as Free On Board Destination with vendor-specified payment terms. While no specific total contract value is disclosed, the procurement requires the contractor to maintain adequate liability insurance, with the Missouri Highways and Transportation Commission (MHTC) and MoDOT named as additional insured parties. Unauthorized repairs could potentially void warranties and manufacturer responsibilities. The single feasible source determination will remain valid for one calendar year, during which MoDOT will continue to monitor the market for potential developing competition. Pinkley Sales Company is identified as both the incumbent and the sole authorized vendor for this specialized equipment.
