About this opportunity

The Commonwealth of Kentucky, through the Kentucky Transportation Cabinet (KYTC) Division of Purchases on behalf of the Division of Maintenance, is soliciting bids for a master agreement contract to supply liquid asphalt materials to support highway maintenance and construction activities across all 120 Kentucky counties and Highway Districts 1-12. The Request for Bid (RFB 605 2300000393) was issued on January 25, 2023, with a bid closing date of February 1, 2023, at 1:30 p.m. Eastern Time, and submissions must be made exclusively through the Kentucky Vendor Self Service eProcurement system with prior vendor registration. Bidders must provide unit pricing per gallon for seven distinct liquid asphalt material groups: Emulsified Asphalt RS-2, AE-200, SS-1h, and HFMS-2; Emulsified Asphalt HFRS-2; and Polymer-Asphalt Emulsions CRS-2P and HFRS-2P, with pricing submitted separately for each Kentucky county or shipping point on either a delivered or pick-up basis. All materials must conform to Section 806 of the Kentucky Transportation Cabinet's Standard Specifications for Road and Bridge Construction, and pricing must be quoted on an F.O.B. Destination Freight Prepaid basis inclusive of applicable Superfund Tax and sales or use taxes. The contract will commence no earlier than March 1, 2023, and extend through February 28, 2024, with quantities estimated but not guaranteed as the Commonwealth will purchase only what is needed during the contract term. For delivered materials, awards will be made to the lowest responsible bidder based on unit price per gallon; for pick-up materials, awards will be based on the sum of the terminal price plus the Department's assumed haul cost of fifteen cents per ton-mile, and vendor-owned storage tanks will be compensated at $500.00 per delivery day. An asphalt price adjustment mechanism applies when the Kentucky Average Price Index fluctuates more than five percent from the bid month to the delivery month, calculated at sixty percent asphalt content on a monthly basis.

The procurement is subject to Federal Highway Administration (FHWA) Buy America provisions, federal funding requirements, and includes reciprocal preference for Kentucky resident bidders, qualified bidder preferences of fifteen percent, and an optional twenty percent preference for Kentucky Correctional Industries. All responsible bidders may be awarded contracts to ensure every Kentucky county has contract coverage, and the Commonwealth has not identified any incumbent vendors or current contractors as part of this solicitation. Bidders must submit required affidavits and certifications attesting to compliance with Kentucky campaign finance laws (KRS 45A.110 and 45A.115) and must maintain registration in the Commonwealth eProcurement System prior to submission. The solicitation includes mandatory federal contract provisions under FHWA-1273, including Davis-Bacon Act wage requirements for projects exceeding $2,000, Contract Work Hours and Safety Standards Act compliance for contracts exceeding $100,000, nondiscrimination requirements under Executive Order 11246 and Title VI of the Civil Rights Act, and safety standards compliance under 29 CFR 1926. No specific contract value or budget range is disclosed in the solicitation documents, as this is a master agreement with estimated but non-guaranteed quantities to be determined by actual state needs throughout the contract period. Interested vendors should contact Jennifer Houchin, CPPB, at 502-782-3977 or Jennifer.Houchin@ky.gov for procurement questions.
