About this opportunity
The City of Tucson is requesting quotes from qualified firms to establish a Service Agreement for lead acid battery recycling, with quotes due July 10, 2026. HUD Section 3 compliance is mandatory: contractors and subcontractors must ensure that 25 percent or more of all labor hours are performed by Section 3 Workers and 5 percent or more by Targeted Section 3 Workers, as defined by HUD income limits and program eligibility under 24 CFR Part 75.
The scope requires collection, transportation, and recycling of lead acid batteries generated from municipal operations in compliance with applicable environmental regulations and industry standards. The selected contractor must demonstrate experience in hazardous waste management specific to lead acid battery handling and recycling, maintain all necessary environmental permits and certifications (including EPA and Arizona Department of Environmental Quality compliance), and comply with data protection and general terms and conditions established by the City. Section 3 business concerns must be at least 51 percent owned by low-income residents, have 75 percent of labor hours performed by Section 3 workers over three months, or be at least 51 percent owned by current public housing or Section 8-assisted housing residents.
Contractor and subcontractor responsibilities include maintaining documentation for five years, including business certification, employee lists, and individual income certifications. Noncompliance with Section 3 requirements may result in contract termination for default, debarment, or suspension from future HUD-assisted contracts. Bidders must complete HUD Forms 5369-B and 5370-C2, certifying compliance with federal debarment status, nondiscrimination laws, conflict of interest regulations, and environmental protection standards. The Offer and Acceptance form requires completion of company information, authorized signatory details, and contact information, with execution by the City's Director of Business Services and approval by the Tucson City Attorney.
