About this opportunity
The Commonwealth of Kentucky Finance and Administration Cabinet, on behalf of the Public Service Commission (PSC) Damage Prevention Enforcement (DPE) division, is seeking proposals for the design and creation of an online damage prevention remedial training module (RFP 758 2600000115) to replace current monthly in-person training sessions. The procured solution must be a comprehensive, interactive, web-based training platform accessible 24/7 via the PSC website with login credentials, delivered in both English and Spanish, covering all content from the existing 2-hour monthly Teams-based training sessions related to the Kentucky Underground Facilities Damage Prevention Act (KRS 367.4901 through KRS 367.4917). The module must include completion tracking capabilities, generate detailed reports with specific data elements (PSC-issued unique identifier, participant name, completion date, duration, and test scores based on 25 interactive questions), issue certificates of completion, and track violations requiring training remediation. Key deliverables include development and implementation within 90 calendar days from contract award (with possible one-month extensions by mutual agreement), ongoing maintenance and updates to reflect statutory changes, daily reporting functionality, and the ability to accommodate approximately 400-500 required users annually with optional public access. Vendors must propose either a customized off-the-shelf digital workplace safety training module or a newly developed eLearning course, maintain the system in-house or propose a cloud-hosted solution compliant with Commonwealth Office of Technology (COT) requirements, and ensure all Commonwealth data remains within the contiguous United States with security controls meeting NIST Special Publication 800-53 moderate-level standards. The evaluation criteria allocate a maximum of 3,500 total points: 2,500 technical points (assessing experience, workplan, results and data reporting, access, approach, and module/data security), 500 cost points for the firm fixed-price proposal, and 500 optional points for oral demonstrations or presentations if required. Vendor written questions were due November 10, 2025, with Commonwealth responses provided November 26, 2025 (updated December 5, 2025); the original proposal deadline of December 11, 2025, at 3:30 p.m. ET was extended to December 19, 2025, at 3:30 p.m. ET per Addendum 1, and vendors must submit both a Proposed Technical Solution and a Proposed Cost Solution electronically by this date.
The procurement does not identify specific set-aside designations for disadvantaged enterprises, though bidders may claim resident bidder status or qualified bidder status (for nonprofits furthering KRS Chapter 163 purposes or qualified nonprofit agencies for individuals with severe disabilities) subject to verification requirements outlined in the Required Affidavit for Bidders, Offerors and Contractors. No incumbent vendor or current contractor is identified in the procurement documents. The initial contract term is two years from the effective award date, with four optional renewal periods of two years each available upon mutual agreement and subject to renegotiation of terms if determined to be in the Commonwealth's best interest; price increases are not permitted during the first twelve months, but may be requested thereafter based on industry-wide price changes with thirty days' written notice and justification, while the Commonwealth reserves the right to reduce prices to reflect industry-wide decreases. Vendors must maintain Commercial General Liability Insurance of $1,000,000 per occurrence and $2,000,000 aggregate, Professional Liability Insurance of $1,000,000 per claim, and Automobile Liability Insurance of $1,000,000 combined single limit, with Certificates of Insurance required prior to award. The Commonwealth is tax-exempt and will not reimburse federal excise tax, Kentucky sales or use tax, travel, lodging, or proposal development costs; specific award values or budget ranges are not disclosed in the solicitation documents, with pricing to be evaluated and compared among responsive proposals submitted during the bidding process.
