About this opportunity

The Commonwealth of Kentucky, Kentucky Transportation Cabinet (KYTC), Division of Purchases, is conducting a one-time procurement for High Performance Winter Asphalt Cold Mix on behalf of the Division of Maintenance. The solicitation seeks delivery of cold mix asphalt material suitable for stockpiling and use in patching applications during cold and damp weather conditions on asphalt or concrete pavement across ten Kentucky districts (Districts 3, 4, 5, 6, 7, 8, 9, 10, and 12), with total quantities ranging from 475 to 850 tons per district depending on county demand. Bidders are not required to respond to all districts but must bid all line items within a selected district to be considered for award; all materials must be delivered within 30 calendar days of contract award or by December 31st, whichever is sooner, with vendors required to provide the requested quantity plus or minus 10 percent for each county. The unit bid price per ton must be quoted F.O.B. Destination Freight Prepaid and Allowed, with vendors responsible for all freight charges and subject to a one percent daily deduction from invoices for each day delivery is delayed beyond the contracted due date, excluding delays beyond the vendor's control. Award will be based on best value using two measurable criteria: price (95 points maximum) with the lowest bidder receiving the highest score, and delivery time (5 points maximum) with the fastest delivery receiving the highest score; bidders guaranteeing delivery exceeding 30 days may be rejected as non-responsive. Written questions must be submitted by November 7, 2024 at 4:00 p.m. Eastern Time, with Commonwealth responses provided by November 8, 2024; the bid closing date is November 22, 2024 at 1:30 p.m. Eastern Time, with a tentative award date of November 22, 2024, and a public bid reading scheduled for 3:00 p.m. Eastern Time on the closing date. All bids must be submitted electronically through the Kentucky Vendor Self Service (VSS) e-procurement system at https://vss.ky.gov, and all bidders must register in this system prior to submission.

The liquid asphalt blend must be sourced from only six Kentucky-approved suppliers: Bond-X High Performance Cold Mix, UPM Cold Mix (Unique Paving Materials), QPR Cold Mix (Quality Pavement Repair), K-Link (Bit Mat Products High Performance Cold Batch), EZ Street Asphalt (EZ Street Company), or Jasa HP High Performance Cold Patch (Hammaker East, Ltd.). Reciprocal preferences for Kentucky resident bidders and qualified bidders apply pursuant to Kentucky Revised Statutes 45A.490-494 and 200 KAR 5:410, with resident bidders receiving preference equal to the preference given by the nonresident bidder's home state, and qualified bidders receiving a 15 to 20 percent preference depending on their classification. The solicitation includes mandatory representations and certifications regarding compliance with Kentucky employment, tax, and safety laws, non-discrimination provisions, ethics compliance, and lobbying prohibitions; bidders must submit required affidavits and certificates of authority documenting compliance with specifications. All bids remain valid for a minimum of 90 calendar days after the closing date. No specific budget range or award value is disclosed in the solicitation documents; vendors are paid only for actual amounts delivered. No incumbent vendors or current contractor information is provided in the available documentation.
