About this opportunity
The Commonwealth of Kentucky, Department of Transportation Cabinet, Division of Purchases, is procuring High Performance Cold Mix (HPCM), a stockpileable asphalt patching material suitable for use during cold and damp weather conditions on both asphalt and concrete pavement surfaces. This Request for Bid (RFB) seeks vendor proposals across ten Kentucky state highway districts with delivery locations at various county maintenance facilities throughout the state, with quantities ranging from 25 to 200 tons per location depending on district requirements. The procurement specifies that only liquid asphalt blends from five approved suppliers will be accepted: UPM Cold Mix (Unique Paving Materials), QPR Cold Mix (Quality Pavement Repair), K-Link (Bit Mat Products), EZ Street Asphalt, and Jasa HP High Performance Cold Patch (Hammaker East, Ltd.). Vendors must bid all line items within any selected district to be considered for award and must guarantee delivery of all requested materials within a specified number of calendar days after contract award, with all materials required to be delivered within 30 calendar days of contract execution. The evaluation criteria allocates 95 points to price (with the lowest bidder receiving maximum points) and 5 points for delivery time (with the best delivery timeframe receiving maximum points); pricing is evaluated on a best-value basis with delivery times exceeding 30 days subject to rejection as non-responsive. Bids were due electronically by November 15, 2023, at 1:30 p.m. Eastern Time through the Kentucky Vendor Self Service system, with a public bid reading scheduled for November 15, 2023, at 3:00 p.m. Eastern Time and a tentative award date of November 20, 2023. A 1 percent per day penalty will be deducted from invoices for each day delivery is delayed beyond the contracted date unless delays result from Commonwealth actions, third parties, or events beyond vendor control.
This is a one-time contract with no renewal options, and the contract will be awarded to the responsive, responsible bidder offering the lowest total price for each district requisition. Kentucky resident bidders may receive reciprocal preference equal to preferences given by other states to their residents, and qualified bidders including Kentucky Correctional Industries, Kentucky Industries for the Blind, and certain nonprofit organizations serving individuals with severe disabilities may receive preferences of 20 or 15 percent of maximum points. The unit bid price per ton must include all labor, materials, and equipment necessary for production and delivery on an F.O.B. Destination Freight Prepaid basis. Payment will be made within 30 working days after receipt of goods and proper invoice, with a 1 percent monthly penalty applied for payments exceeding 30 working days. All bidders must submit an Annual Affidavit certifying compliance with Kentucky campaign finance laws (KRS 45A.110 and 45A.115), and responses must be submitted through Kentucky's online Vendor Self Service system with all required documentation and attachments included. No federal funding restrictions are specified in the solicitation, and specific budget or award values are not disclosed, as pricing will be determined through the competitive bidding process across the ten districts.
