About this opportunity
The Commonwealth of Kentucky Finance and Administration Cabinet, on behalf of the Kentucky Department of Parks, issued a Request for Bid (RFB 758 2300000161) for FMC Golf Course Chemicals on September 9, 2022. This procurement seeks to establish a Master Agreement for golf course chemicals, requiring vendors to bid all four specified line items or face rejection. The required products include 55 units of Serata (35 oz.), 8 units of Triple Crown (1 gallon), 6 units of Fame (One Pint), and 38 units of Dismiss NXT (10 oz.), with all products requiring registration for use in golf course turf. Bidders may propose approved equal products or alternate brands provided they submit adequate descriptive literature for verification. The initial contract period is one year from the date of award with four optional one-year renewal periods available subject to written approval and potential renegotiation of terms. Written questions were due by September 16, 2022, at 10:00 AM ET, with bids closing on September 23, 2022, at 1:30 PM ET. Award determination will use a best value ranking approach with price weighted at 90 points and delivery weighted at 10 points, with delivery required on an F.O.B. Destination Freight Prepaid and Allowed basis, and vendors must clearly state specific delivery times in working days or face a one percent daily deduction from invoices for late delivery. Prices must remain valid for a minimum of 60 days after the bid due date and must exclude federal excise taxes and Kentucky sales or use taxes, with price increases prohibited during the first 12 months and thereafter only permitted upon 30 days' notice with supporting documentation of industry-wide price changes.
Kentucky resident bidders are eligible for reciprocal preference equal to preferences given by nonresident bidders' states, and qualified bidders including Kentucky Correctional Industries, Kentucky Industries for the Blind, and certain nonprofit organizations serving individuals with disabilities receive preferences of 20 percent and 15 percent of maximum points, respectively. Vendors must register in the Commonwealth eProcurement System prior to bid submission and submit electronic bids exclusively through the eProcurement system at https://emars311.ky.gov/webapp/vssprdonline3111d/AltSelfService, along with a Kentucky Tax Registration Form (Revenue Form 10A100), certificates of authority for foreign entities, required affidavits executed and notarized by a duly authorized representative, and EEO forms if applicable. All bidders must execute an Annual Affidavit certifying compliance with Kentucky campaign finance laws, tax obligations, and various statutory requirements, including non-delinquency on state taxes and fees, non-engagement in prohibited boycotts, and non-employment of executive agency lobbyists convicted of contract-related crimes. Past vendor performance may be considered in award determinations, with vendors demonstrating poor performance records in the last 12 months potentially deemed non-responsible and ineligible for award. The solicitation did not specify a budget range or award value, as estimated quantities were provided for reference only and the Commonwealth is obligated to purchase only what agencies require during the contract term.
