About this opportunity

The Utah Division of Purchasing is publishing a Notice of Intent to Award a Contract Without Engaging in a Standard Procurement Process for Hindenburg ABC recording software on June 9, 2026, under FB26-47 Contract 256319 AMD 1. This is a sole-source procurement; the vendor (Hindenburg Systems ApS) is asserted to be the only available source for the proprietary audiobook recording software.

The estimated contract value is $8,432.00 with no freight costs. The award will be an Agency Contract with a five-year term and renewal options. This amendment increases the total contract amount from the original $50,804.00 under solicitation FB25-30 to $58,432.00, a 15.015 percent increase driven by the need for additional licenses for expanded recording and editing purposes. The incumbent vendor is Hindenburg Systems ApS under existing Contract Number 256319.

Interested vendors who believe other qualified sources exist for the identified procurement item or can demonstrate comparable or superior products, equivalent proprietary items, or cost comparisons related to transitional expenses may submit challenges during the public notice period. If no valid challenges are received and the Division of Purchasing determines a sole-source justification, the contract will be awarded without competition. If other qualified vendors meeting the specifications are identified, the Division may pursue a standard procurement process unless the award justification is based on transitional costs or impracticability.

All vendors responding to this notice must comply with Utah Code 63G-27 et seq., certifying they are not engaged in economic boycotts or boycotts of the State of Israel and agreeing to maintain such compliance for the contract duration. Vendors may submit trade secrets and commercial financial information under protection of the Government Records Access and Management Act (GRAMA) using the Business Confidentiality Claim form, submitting both redacted and non-redacted versions with concise statements of reasons supporting confidentiality claims.

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS The Division of Purchasing is publishing this notice pursuant to the Utah Procurement Code. The Conducting Procurement Unit submitted this form to the Division of Purchasing claiming that it intends to award a contract without competition if it is determined by the Division of Purchasing, in writing, that: - there is only one source for the procurement item; - transitional costs are a significant consideration in selecting a procurement item; or - the award of a contract is under circumstances, described in rules adopted by the applicable rulemaking authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit. In the Files section the Conducting Procurement Unit has identified its justification for wanting to award a contract without engaging in standard procurement process. You MUST read all of the documentation in the Files.
