About this opportunity
The Texas Comptroller of Public Accounts Statewide Procurement Division is soliciting sealed bids for scheduled delivery of dairy and juice products to the Texas Department of Public Safety, Texas Juvenile Justice Department, and Texas School for the Deaf under IFB 304T-26-380M1.1, with bids due July 20, 2026 at 1:30 p.m. Central Time and a pre-bid conference on June 25, 2026.
Buy American compliance is required for specified line items, mandating that products be domestic commodities or processed in the United States using at least 51 percent domestically grown agricultural commodities. All dairy and juice products must meet school meal standards, including temperature requirements (33°F to 41°F for refrigerated items) and minimum shelf-life benchmarks (12 days for fluid milk with 7 days post-opening; 21 days for other products with 14 days post-opening). The scope encompasses 182 line items across butter, cottage cheese, sour cream, ice cream, milk varieties, sherbet, yogurt, frozen yogurt, and fruit juices with specified fat content, vitamin fortification, packaging formats, and case capacities. Delivery locations include eight Texas Juvenile Justice Department facilities (El Paso, Edinburg, Harlingen, San Antonio, Brownwood, Giddings, Gainesville, and Mart), plus Department of Public Safety and Texas School for the Deaf locations in Austin.
The initial contract term commences on the Notice of Award effective date and expires November 30, 2027, with three renewal options through November 30, 2029 and up to one additional year thereafter. Pricing must be firm, all-inclusive, and fixed with FOB Destination delivery included in unit prices. Annual price adjustments after the initial term may be requested based on the Consumer Price Index for Texas Juvenile Justice Department and Texas School for the Deaf locations or the Producer Price Index for Department of Public Safety locations, subject to a specified maximum-increase formula. No minimum purchase volume is guaranteed; quantities on the mandatory price sheet reflect historical usage estimates. Contractors must maintain minimum commercial general liability insurance of $500,000 per occurrence. Questions are due July 2, 2026, and public bid opening occurs July 21, 2026.
