About this opportunity

The Dallas Area Rapid Transit Authority (DART) is soliciting bids for a Blanket Purchase Order (BPO) for Third Party Administrator (TPA) Claims Services to manage bodily injury and property damage claims arising from commuter rail passenger services. This procurement encompasses comprehensive claims administration services including adjuster services, appraisal fees, mileage and travel reimbursement, photographs, video services, police and fire report acquisition, courier services, and clerical support. The successful vendor must establish procedures for claim acceptance and documentation, designate qualified staff for field investigations and evidence collection, initiate recorded statements from claimants, coordinate investigations with service providers and witnesses, submit initial investigation reports within one week of obtaining statements and photographs, and provide status reports at intervals determined by claim severity with a minimum quarterly requirement. The TPA will be responsible for developing settlement procedures in coordination with DART, managing litigation coordination through legal counsel, identifying recovery opportunities including subrogation and deductibles, and implementing safeguards for claim payment disbursement with monthly reconciliation due by the fifth day of each following month. The contract covers a 12-month base performance period with pricing required for 11 distinct line items, and the proposal submission deadline is April 21, 2026. All pricing must be all-inclusive of supervision, labor, equipment, materials, licensing, warehousing, freight, and all other associated charges, with FOB Destination shipping terms and freight costs included in the overall bid price. Payment terms are Net 30, with invoices submitted in triplicate to APInvoices@dart.org, and payment made 30 days from receipt of invoice or order, whichever is later.

The procurement documents do not explicitly identify any set-aside designations, disadvantaged enterprise restrictions, or incumbent vendor information. Vendors must comply with DART's standard Purchase Order Terms and Conditions, which include equal opportunity employment provisions, certifications regarding foreign terrorist organizations and Israel boycott compliance, and strict adherence to specified delivery times and rates, with failure to meet delivery specifications serving as grounds for rejection and default termination. The solicitation requires vendors to register in the BONFIRE platform to access detailed project specifications and submit bids through the in-browser BidTable. No specific award value or budget range is disclosed in the available procurement documents, though the scope encompasses claims services across multiple transit authorities including DART, Fort Worth Transit Authority (Trinity Metro), Trinity Railway Express (TRE), Herzog Transit Services, Union Pacific Railroad, and Burlington Northern Santa Fe Railroad. The contracting process is subject to DART's change order procedures, dispute resolution mechanisms with 30-day appeal periods, and the Authority's right to terminate orders for default or for convenience at its discretion.

In such event, the Seller shall be liable for damages, including the excess cost of reprocuring similar supplies or services or completing construction; provided that, if (i) it is determined for any reason that the Seller was not in default, or (ii) the Seller's failure to perform is without his and his subcontractor's control, fault, or negligence, the termination shall be deemed to be a termination for convenience under paragraph 12.
