About this opportunity
Cache County School District's Department of Purchasing in Utah is publishing notice of its intent to award a sole-source contract to Mountain States School Book Depository for textbook procurement, with the notice due November 3, 2026. The award would proceed without competition under the Utah Procurement Code and Utah Administrative Code R33-8, with the district's stated justification that Mountain States is the only source. That justification rests on Utah State Board of Education Rule R277-469, which requires publishers to keep at least 10 physical books and tangible adopted materials at an approved instructional materials depository within the state. Digital and online resources are exempt from the in-state storage requirement.
The vendor is located in Clearfield, Utah, with Scott Cressall as the listed contact. Pricing is F.O.B. Destination, Freight Prepaid. The district's documentation states that no personal, financial, or fiduciary relationships exist between the requesting department and the proposed vendor. Because the contract value exceeds $50,000, public notice is required under Section 63G-6a-112. The contract is not awarded until the procurement unit, vendor, and Purchasing Department all sign it.
The estimated contract value is $15 million over a five-year term, with a five-year renewal option. Under R277-469, contract prices for recommended materials hold for five years from the contract date. The rule also permits publishers to request substitution of revised editions while maintaining original contract prices, ensuring classroom compatibility between editions, supplying sample copies, and submitting revised editions in NIMAS file format to NIMAC.
Opportunity text
The Cache County School District ("CCSD") Department of Purchasing is publishing this notice pursuant to the Utah Procurement Code. The Conducting Procurement Unit submitted this form claiming that it intends to award a contract without competition if it is determined by the Department of Purchasing, in writing, that: ○ There is only one source for the procurement item ○ Transitional costs are a significant consideration in selecting a procurement item; ▪ or the award of a contract is under circumstances, described in Utah Administrative Code R33-8, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit. In the Files section the Conducting Procurement Unit has identified its justification for wanting to award a contract without engaging in standard procurement process. You MUST read all of the documentation in the Files
