About this opportunity

The Utah Office of Attorney General's Investigation Division has published a Notice of Intent to Award a Contract Without Engaging in a Standard Procurement Process for ANDE Rapid DNA Supplies and Service, with a challenge-submission deadline of June 9, 2026. This is a sole-source procurement — the Division claims ANDE Corporation is the only vendor whose Rapid DNA system is FBI-approved for use at NDIS by accredited forensic DNA laboratories and the only manufacturer of chips compatible with ANDE instruments. The estimated contract value is $67,600 ($64,900 for A and I Chips for ANDE model i7074 instruments plus $2,700 in freight, F.O.B. Destination, Freight Prepaid).

The scope includes A and I Chips for ANDE instruments and ANDE Rapid DNA Analysis subscription services for investigative field work. The Division's market research identified no competing vendors and found no comparable cooperative state contracts.

Interested vendors may challenge the sole-source determination by June 9, 2026 by submitting documentation demonstrating competing sources, comparable or superior products meeting specifications, or cost analyses comparing transitional expenses. Challenges must comply with Utah Code 63G-6-105 and include a certification that the vendor is not engaged in economic boycotts or boycotts of the State of Israel and will not engage in such conduct during contract performance. If no valid challenges are received, the Division of Purchasing may proceed with award to ANDE without competition. Contract funding may be supplemented if the legislature appropriates additional funds for the identified scope.

Vendors claiming confidential trade secrets or commercial financial information must submit a Business Confidentiality Claim form with both redacted and non-redacted versions of their proposals.

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS The Division of Purchasing is publishing this notice pursuant to the Utah Procurement Code. The Conducting Procurement Unit submitted this form to the Division of Purchasing claiming that it intends to award a contract without competition if it is determined by the Division of Purchasing, in writing, that: - there is only one source for the procurement item; - transitional costs are a significant consideration in selecting a procurement item; or - the award of a contract is under circumstances, described in rules adopted by the applicable rulemaking authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit. In the Files section the Conducting Procurement Unit has identified its justification for wanting to award a contract without engaging in standard procurement process. You MUST read all of the documentation in the Files.
