About this opportunity

The West Virginia Department of Environmental Protection is requesting bids for site remediation and reclamation services on the Brushy Meadow Creek Highwall B abandoned mine lands project, with bids due September 21, 2026 at 10:30 a.m. and a mandatory pre-bid meeting on September 2, 2026 at the jobsite. Attendance at the pre-bid meeting is mandatory for bid consideration.

The scope encompasses approximately 49–51 acres of excavation, backfill, and revegetation to reclaim highwall and steep slopes in Nicholas or Fayette County. Deliverables include mobilization and demobilization, construction layout, quality control, site preparation, erosion and sediment control (super silt fence and rock check dams), stabilized construction entrance materials, drainage infrastructure (fabric form channels, vegetated channels, underdrains, conveyance piping, and level spreaders), and revegetation. The contractor is responsible for surveying, establishing construction baselines, measuring completed quantities, and ordering all materials. Quantities include 601,042 cubic yards of unclassified excavation, 8,723 linear feet of super silt fence, 475 tons of stabilized construction entrance material, 42 rock check dams, 7,679 linear feet of fabric form channel, and 537 linear feet of 12-inch PVC conveyance pipe.

The contract term is an initial one year with potential renewals of up to three successive one-year periods, contingent on mutual written consent and Attorney General approval. Work is federally funded through abandoned mine lands reclamation programs; Davis-Bacon wage rates apply. For projects exceeding $500,000, contractors must hire at least 75% of employees from the local labor market and use only domestic steel, aluminum, and glass products unless the spending officer authorizes otherwise in writing.

Mobilization and demobilization costs cannot exceed 5% of the total bid, construction layout 5%, quality control 3%, and site preparation 5%. Bid bonds must equal 5% of the total bid; performance and labor/material payment bonds must each equal 100% of contract value. Commercial General Liability and Automobile Liability insurance must cover at least $2,000,000 per occurrence. Pricing is firm for the contract life. Liquidated damages are $1,000 per working day for delays beyond the completion date. Technical questions are due September 10, 2026. Contact April D. O'Dell, buyer, at (304) 414-1145 or april.d.odell@wv.gov.
