About this opportunity
The West Virginia Department of Environmental Protection, Office of Oil and Gas, is soliciting bids for construction, reclamation, and plugging of the orphaned Adkins #2 Well (API# 47-099-00071) in Wayne County under ARFQ DEP27-016, with bids due September 28, 2026, at 11:30 AM Eastern and a mandatory pre-bid meeting at the wellsite on September 16, 2026, at 11:00 AM Eastern.
The scope encompasses three primary service components: permitting, well plugging, and wellsite reclamation for the well located at 834 Vaughn Cemetery Road in Genoa, WV, drilled in 1950. Contractors must comply with Davis-Bacon prevailing wage requirements, with all laborers and mechanics paid weekly at Secretary of Labor–determined rates. All materials, including steel and manufactured products, must be produced in the United States unless subject to an approved waiver. A liquidated damages provision of $1,000 per working day applies for delays beyond the contract completion period. Wells exhibiting methane emissions greater than one gram per hour post-plugging or indications of fluid leakage require remedial work at the contractor's sole expense with no additional compensation.
The contract is structured as a one-year term with potential for three successive one-year renewals, contingent upon mutual written consent and approval by the Department and Attorney General's office. Funding derives from Section 40601 of the Infrastructure Investment and Jobs Act (IIJA). Bidders must submit a 5% bid bond; the apparent successful vendor must provide performance and labor/material payment bonds each at 100% of the contract value, along with commercial general liability and automobile liability insurance with minimum limits of $2 million per occurrence. Seventy-five percent of employees must be sourced from the local labor market. Compliance with the Endangered Species Act, State Historic Preservation Office requirements, and all applicable federal, state, and local regulations is required. Technical questions are due September 18, 2026, at 1:30 PM Eastern. Herminio David Robles (david.h.robles@wv.gov, 304-414-1155) is the buyer contact.
