About this opportunity

Pennsylvania is soliciting food items for the second quarter of 2026 (October through December) under the 5000 OMHSAS NSH — Diet Cart 1 procurement, with proposals due August 17, 2026. The scope covers food supply for Northern Cambria Borough and Montgomery County. Pennsylvania's Executive Order 2010-03 establishes a preference for Pennsylvania-produced agricultural products where available at competitive prices; vendors must certify compliance with the Pennsylvania Preferred sourcing requirements, including research of available PA producers prior to purchase, and must report sourcing outcomes to the Department of Agriculture.

All contractors must execute a Workers Protection & Investment Certification (BOP-2201) certifying compliance with Pennsylvania's Unemployment Compensation Law, Workers' Compensation Law, and applicable state labor and workforce safety statutes, including minimum wage, prevailing wage, equal pay, workplace misclassification, child labor, and employment verification requirements. False certification carries penalties including contract termination and three-year ineligibility to bid on Commonwealth contracts under 62 Pa. C.S. 531, as well as criminal liability under 18 Pa. C.S. 4904 for unsworn falsification to authorities. Contractors must report any changes in compliance status to the purchasing agency immediately upon discovery.

Vendors must certify non-debarment and eligibility status under Pennsylvania's Reciprocal Limitations Act, demonstrating they are not debarred, suspended, or otherwise ineligible for federal contracts, and must comply with all applicable federal and state regulations regarding business integrity. Compliance is required throughout the contract term and subject to verification by the Commonwealth. Non-compliance may result in contract termination, debarment from future procurements, and legal action.
