About this opportunity
The Commonwealth of Pennsylvania's Office of Mental Health and Substance Abuse Services (OMHSAS) is soliciting bids for produce products for the January–March 2027 quarter under solicitation 5000-OMHSAS-CSSH, with responses due November 13, 2026. Executive Order 2010-03 directs Commonwealth agencies to procure Pennsylvania-produced agricultural products when available at competitive prices, subject to U.S. and Commonwealth law and reciprocal preference statutes of other states. A separate Reciprocal Limitations Act requirements file governs bidder eligibility and award evaluation. Place of performance is Lackawanna County, Pennsylvania.
The primary specification covers prepared fresh vegetables across eleven commodity items, including broccoli, cabbage, carrots, cauliflower, celery, head lettuce, onions, sweet peppers, potatoes, radishes, and mixed salad greens, each available in multiple preparation styles and package sizes. Processing facilities must comply with the Pennsylvania General Food Law and pass annual inspection. Products must be vacuum-packed in plastic bags within master cartons, labeled with product identification, processor name and location, net weight, processing date, and any additives. Deliveries must be completed within two days of processing, with a minimum seven-day shelf life from processing date. Products must be held at 32–36°F and transported in refrigerated trucks. Sulfites are prohibited, and other FDA-approved preservatives must be disclosed on labels. A separate Department of Human Services listing covers 31 fresh fruit and vegetable items, with unit pricing and total cost columns for bidders to complete.
Quantities are estimates and may be increased or decreased based on facility requirements. The Commonwealth may cancel any quantity with five days' prior notification and pays only for products it accepts. Failure to meet delivery specifications may result in surcharges and/or product rejection, and any delivery schedule change requires prior approval from the Director of Dietary Services.
Bidders must submit a completed Worker Protection and Investment Certification (BOP-2201) under Executive Order 2021-06 with their bid documentation. The certification attests compliance with Pennsylvania's Unemployment Compensation Law, Workers' Compensation Law, and thirteen state labor and workforce safety laws, and requires immediate reporting of any change in compliance status. False certification carries contract termination and three-year ineligibility to bid on Commonwealth contracts under 62 Pa. C.S. § 531, and is subject to 18 Pa. C.S. § 4904.
