About this file
This is a Worker Protection and Investment Certification Form (BOP-2201) issued by the Commonwealth of Pennsylvania pursuant to Executive Order 2021-06, applicable to the produce supply contract for the Office of Mental Health and Substance Abuse Services (OMHSAS) covering the third quarter period of January through March 2027. The form establishes mandatory compliance requirements for all contractors and grantees working with the Commonwealth of Pennsylvania. Contractors must certify compliance with Pennsylvania's Unemployment Compensation Law, Workers' Compensation Law, and thirteen specific state labor and workforce safety laws, including the Construction Workplace Misclassification Act, Employment of Minors Child Labor Act, Minimum Wage Act, Prevailing Wage Act, Equal Pay Law, and other employment-related statutes. The certification requires a duly authorized official to execute the form on behalf of the contractor, confirming the contractor's compliance status with all applicable laws and establishing an obligation to report any changes in compliance status to the purchasing agency immediately.
The form specifies that Pennsylvania law establishes penalties for providing false certifications, including contract termination and three-year ineligibility to bid on future Commonwealth contracts under 62 Pa. C.S. § 531 (Debarment or Suspension). Additionally, the certification is subject to the provisions and penalties of 18 Pa. C.S. § 4904 (Unsworn Falsification to Authorities). The form was published on February 7, 2022, and must be completed and submitted as part of the contractor's bid documentation for the produce supply contract. No pricing terms, set-asides, or specific funding amounts are detailed in this certification form, as it functions solely as a compliance verification document.
