About this opportunity
The Department of Justice Office of Justice Programs Bureau of Justice Assistance is soliciting applications for the OJP FY 2026 Special Attorneys Program Round 8, with an SF-424 submission deadline of September 21, 2026, and no cost-share requirement.
Eligible applicants are state governments, county governments, city or township governments, federally recognized Tribal governments, and other units of local government (towns, boroughs, parishes, villages, or other general purpose political subdivisions of a state) that have legal, operational, and managerial capacity to employ cross-designated prosecutors and are willing to enter into a memorandum of understanding with the relevant federal division or U.S. Attorney's Office.
The program funds full-time or part-time prosecutors assigned or hired to serve as Special Attorneys under the National Fraud Enforcement Division or Criminal Division, or as Special Assistant United States Attorneys (SAUSAs) within a United States Attorney's Office. Cross-designated prosecutors remain employees of their home agencies while investigating and prosecuting fraud and crimes committed by aliens within the United States; they may also be assigned drug or human trafficking cases. Funding may support criminal investigators, analysts, forensic accountants, and investigative support staff. Applicants may request up to 20 percent of award funds for Justice System Staffing and Capacity or Equipment and Technology Purchase.
Award amounts are based on approved costs requested by applicants, with a total program funding pool of $300 million and an expected 36-month award period beginning June 1, 2026. Awards are made on a rolling basis as applications are received and approved.
The proposal narrative carries 85 percent of evaluation weight: 20 percent for goals and objectives, 35 percent for design and implementation, and 30 percent for capabilities and competencies; budget comprises 15 percent. Required application components include statutory authority documentation, a letter of support from the relevant federal office, resumes and bar admission proof for designated attorneys, and a timeline.
The program operates under Public Law 119-21, Title X, Subtitle A, Part II, Section 100055 (34 U.S.C. 61101), and is assigned to CFDA 16.076.
Synopsis
This is a notice of funding opportunity (NOFO) for the OJP FY 2026 Special Attorneys Program. This program will support state, local, Tribal, and territorial prosecuting agencies to assign or hire qualified prosecutors to serve full-time or part-time (on a case-by-case basis) as Special Attorneys under the direction of the National Fraud Enforcement Division or the Criminal Division, or to serve as Special Assistant United States Attorneys (SAUSAs) within a United States Attorney's Office. These "cross-designated" prosecutors will remain employees of their home agencies but will investigate and prosecute assigned fraud and other crimes committed by aliens within the United States (hereafter referred to as "criminal aliens") for the duration of their appointment under this program. Cross-designated prosecutors may also be assigned cases involving drug or human trafficking committed within the United States. The National Fraud Enforcement Division, Criminal Division, and United States Attorney's Offices will coordinate with selected prosecutor offices on a case-by-case basis to address logistics and any unique local circumstances. This grant program, authorized under Public Law 119-21, Title X, Subtitle A, Part II, Section 100055 (codified at 34 U.S.C. § 61101), is intended to strengthen investigative and prosecutorial capacity, expand intergovernmental coordination, and enhance the ability of jurisdictions to investigate and prosecute fraud and other crimes committed by aliens within the United States, as well as investigate and prosecute drug and human trafficking crimes. The program is also intended to increase the availability of cross-designated prosecutorial personnel who can pursue these matters in coordination with federal authorities and contribute to the effective enforcement of applicable criminal laws.
Eligibility
Other Units of Local Government: For the purposes of this NOFO, other units of local government include towns, boroughs, parishes, villages, or other general purpose political subdivisions of a state.
