About this opportunity

The National Institutes of Health (NIH), a civilian agency within the Department of Health and Human Services, has issued a Special Notice regarding a sole-source procurement for specialized mouse caging equipment. The notice indicates an intent to award a Firm-Fixed Price purchase order to Lab Products, LLC for their unique Zyfone Super Mouse Caging system. The procurement is specifically for 100 cases of Zyfone Super Mouse Caging and 50 cases of Super Mouse Filter Tops, categorized under the NAICS code 332999 for miscellaneous fabricated metal product manufacturing. Lab Products' caging system is distinguished by a patented bio-containment design with unique safety features not available from other manufacturers, including negative pressure ventilation and specialized containment mechanisms. The procurement is being conducted under FAR Part 6.302-1, which allows for a non-competitive award when only one source can provide the required services.

The purpose of the Special Notice is to inform potential contractors about the NIH's intended procurement and provide an opportunity for other companies to demonstrate comparable capabilities. Contractors interested in challenging the sole-source determination must submit a written capability statement demonstrating their ability to satisfy the requirement by 12 p.m. EST on January 24, 2025. Responses must be emailed to zetherine.gore@nih.gov and include the Notice ID #SS-NIH-7123867 on the subject line. The government retains sole discretion to determine whether to compete the proposed award based on submitted responses. Key eligibility criteria include the ability to provide a caging system with equivalent safety features, compatibility with existing equipment, and potential to ensure animal and human safety. The NIH anticipates issuing the award approximately five days after the notice date unless another company can definitively prove its capability to meet the specific technical requirements of the Lab Products caging system.

Notice text

The National Institutes of Health (NIH) intends to award a Firm-Fixed Price purchase order to Lab Products, LLC.

In accordance with FAR Part 6.302-1, the Contractor is the only known responsible source who can provide the services for the requirement listed below.

The purpose of this notice is to inform the public that the NIH, Office of Research Services  intends to issue a purchase order to Lab Products, LLC for  Zyfone Super Mouse Caging, #75031-GA (100 cs), Super Mouse Filter Tops, #10182ZF (50 cases).  The Lab Products patented bio-containment design has unique safety features not found in other cage manufactures products. The ventilated cage system maintains negatively pressurized cages in a controlled environment for housing conditions. It ensures protection between the cages, the animal room, and the animal care staff. Their design provides containment and micro-isolation from cage to cage, cage to room, and room to cage. Through a trademarked system, the cages only exhaust through negative pressure and do not become positive. Other safety features in this patented design include, in the event of a power failure, cages that revert to a static mode preventing possible animal health issues.

There are no resellers of Lab Products’ caging.  Other cage manufacturers would have to reverse engineer these proprietary products which would be costly and time consuming and may have the potential to violate patent and trademark laws.  Cage purchases must be compatible with existing equipment to ensure animal and human safety.

This notice is not a request for competitive quotes.  However, any party that believes it can fulfill the requirement as stated herein may submit a written capability statement with information that clearly supports and demonstrates the ability to satisfy the requirement.  A determination by the Government to compete this proposed award based upon responses to this notice is solely within the discretion of the Government.

It is anticipated that an award will be issued approximately five (5) days after the date of this notice unless the Government determines that another company has the capability to satisfy this requirement.

Responses to this notice must include the Notice ID #SS-NIH-7123867 on the subject line of the email. Please email responses to zetherine.gore@nih.gov no later than 12 p.m. EST on Friday, January 24 , 2025.
