About this opportunity

The Library of Congress Office of Chief Information Officer has published a Special Notice announcing its intent to award a sole source contract to Xytech Systems LLC for maintenance and support of Xytech software. This notice serves as advance notification under Federal Acquisition Regulation requirements for a proposed non-competitive procurement valued over $250,000. The Library intends to negotiate directly with Xytech Systems LLC, located in Chatsworth, California, as the sole owner of the Xytech source code. The contract will provide continued maintenance and support for the Library's perpetual Xytech software licenses, including updates and technical support access. This procurement specifically supports the National Library Service for the Blind and Print Disabled's Production Information Control System 2 (PICS2). The Library justifies the sole source approach by citing that only one source is available with no possible substitutions under federal acquisition regulations.

The primary purpose of this Special Notice is to inform potential contractors of the Library's intent to award without competition while providing an opportunity for other qualified sources to demonstrate their capabilities. Any organization believing it can provide the required Xytech software maintenance and support services must submit a detailed capability statement by 10:00 AM EST on August 19, 2025, via email to the designated contracting officer and contract specialist. The contract performance period spans from January 31, 2026, through January 30, 2027, for the base year, with potential extension through January 30, 2029, if all options are exercised. The government plans to award the contract within 24 days of the notice publication date. Respondents must demonstrate sufficient qualifications and detail in their capability statements to allow the government to evaluate their ability to perform the required work, though the government reserves full discretion in determining whether to proceed with competitive procurement based on responses received.

Notice text

This notice is published in accordance with Federal Acquisition Regulation (FAR) 5.101(a)(1) requiring the dissemination of information regarding proposed contract actions. This is a Notice of Intent to award a sole source, firm-fixed price purchase order under the authority of 41 U.S.C. 3304(a)(l), as implemented by FAR 13.106-1(b)(1)(i) – only one source available, no substitutions possible – and is not a request for competitive proposals.

The Library of Congress (Library), Office of Chief Information Officer (OCIO) intends to negotiate on a sole source basis with Xytech Systems LLC, 9410 Topanga Canyon Blvd. Suite 200, Chatsworth, CA 91311-5758. This requirement is to provide continued maintenance and support of the Library’s perpetual Xytech software to include the latest software version, updates, and access to Xytech’s support help desk. Xytech Systems LLC is the sole owner of Xytech source code and is the only source available to provide support of the existing software licenses.

Period of Performance: The total period of performance for this requirement is January 31, 2026 – January 30, 2027 for the base year, and an overall period of performance from January 31, 2026 – January 30, 2029 if all options are exercised.

This will be the only notice of the Government's intent to solicit, negotiate, and award to one source to satisfy this requirement. The Government plans to award a contract for this requirement within 24 days of this notice.

THIS IS NOT A SOLICITATION FOR COMPETITIVE QUOTATIONS. All responsible sources that can provide the reagents should submit a capability statement via email to Ameen Dozier, Contracting Officer, at adoz@loc.gov and Brandon Mose, Contract Specialist, at bmose@loc.gov by 10AM EST on Tuesday August 19, 2025. A determination not to compete this requirement, based upon responses to this notice, is solely within the discretion of the Government. Any responses received by the Library after this date and exact time specified are late and will not be considered.

This notice does not obligate the Government to award a contract or otherwise pay for any information provided in response. The Government reserves the right to use information provided by respondents for any purpose deemed necessary and legally appropriate. Any organization responding to this notice should ensure that its response is sufficiently detailed to allow the Government to determine the organization's qualifications to perform the work. Respondents are advised that the Government is under no obligation to acknowledge receipt of the information received or provide feedback to respondents with respect to any information submitted.
