VISA CONTINGENCY CONTRACT INDUSTRY DAY
USTRANSCOM TCAQ-I and the ERC plans to conduct an informal VISA Contingency Contract Industry Day on 10 December 2014 from 12:30pm-4:30pm Central Time. The Industry Day will be held at Scott Air Force Base, IL, Building 1948, Classroom 140 (see attached map). The purpose of this Industry Day is to discuss the updated draft documents and recommended ways forward for the contingency contract. The Government will not provide any reimbursement for attending this Industry Day general session.

Request VISA contingency questions/comments/concerns for industry day discussions be submitted via email no later than COB 5 December 2014. Carriers interested in attending the Industry Day must submit an email no later than 12:00pm Central Time on 8 December 2014 to Melinda Lewis (melinda.j.lewis9.civ@mail.mil), Dave Hoag (david.m.hoag.civ@mail.mil), and Nick Weiss (nicholas.e.weiss.civ@mail.mil). Attached are the final VISA solicitation documents combining charter and liner sealift requirements. Due to the non-competitive and voluntary nature of this requirement, standard source selection procedures do not apply. Discussions are NOT limited and TCAQ will maintain ongoing communications throughout to facilitate contract execution with each participant as desired to finalize all documentation.
The response date of 27 Aug 15 is a cut-off date identified to allow my team sufficient time to get all VISA participant's contracts in place effective 1 Oct 2015. However, the VISA solicitation will remain open for the entirety of the VISA contract performance period for new entrants enrolling in VISA during MARAD's open season.

VISA Contingency Contract - Industry Meeting
USTRANSCOM TCAQ-I and the ERC plans to conduct another informal VISA Contingency Contract Industry Meeting on 3 June 2015 from 1:00pm - 4:30pm Central Standard Time. The location of the meeting facility is outside Scott AFB at the MITRE facility located on the corner of Route 158/Air Mobility Drive and Seibert Road. Upon front door facility entry, you will sign in at the reception desk to get a badge and be directed to the meeting room.
The purpose of this Industry meeting is to discuss the results of the JPAG TTX related to the VISA Contingency Contracts, the updated draft documents and requirements forward for the renewed FY16 contingency contract. (Agenda Attached) The Government will not provide any reimbursement for attending this Industry meeting general session.

VISA Contingency Contract - Industry Day Agenda
Attached is the agenda for the Industry Day scheduled Wednesday, December 10th from 12:30 - 4:30 CST. For those attending and needing base access, passes have been requested and will be ready for pick-up. Please plan accordingly since base access during lunch is hectic and often delayed. We recommend arriving at the Visitor Control Center by at least 1100 to ensure timely arrival to the meeting. Unfortunately, the room in which we secured for the meeting does not have any phone support, thus we are unable to accommodate dial-in/conference call requests as originally anticipated. VISA Contingency Contract - Liner T&C's - Pricing Update
As previously noted in the VISA contingency contract renewal announcement, the specific liner terms and conditions were not included and were being validated and reconciled with current Universal Services Contract (USC) and Regional Domestic Contract (RDC) liner requirements as applicable. As the process evolved, questions regarding redundancy and needs in an activated VISA state were discussed and internal government recommendations considered. In addition, the VISA liner pricing bid schedule was analyzed and strings of service and rates on contract reviewed. In the end, we agreed that we may be best served by seeking industry recommendations prior to revising or validating historic VISA contingency contract terms, conditions and pricing that may already exist within our peacetime contracts and sufficiently meet our needs in a contingency state. Additionally, the Rate Methodologies previously approved and utilized will remain unchanged (Revenue Based, Peacetime and Negotiated) for pricing both charter and liner service; however, we will propose revising how the DCAA audits are to be conducted.
Beyond improving the VISA contingency contracts, our goal in moving forward with the FY16 VISA renewal is to keep the process less onerous for industry. Linking VISA to the USC and RDC contracts of record and supplementing only the VISA liner contingency terms and conditions is something we'd like to explore at the industry day and may serve both industry and government best. Following discussions, we'll post the recommended supplemental VISA liner terms and conditions as well as pricing instructions. The purpose of this Industry Day is to discuss the draft documents already posted and recommended ways forward for the FY16 VISA contingency contract renewal. We look forward to lively discussions and your recommendations. An agenda is being formulated and will posted within the next few days.

Market Research Request for Information
Instructions:
Attached is the initial "DRAFT" VISA contingency contract solicitation with updated regulatory requirements and liner and charter terms and conditions for the FY16 renewal. Within, for every requirement, term or condition, comments are provided to the side of the text detailing the changes, if any. This initial draft is not all inclusive and merges the previous separate contracts common liner and charter terms and conditions (T&C's) under a general T&C section as well as segregates specific liner and charter T&C's as appropriate. The charter T&C's within are solid requirements based upon current charter contract requirements. However, the specific liner T&C's are not included and are being revised based upon known changes since 2005 and validated to coincide with current Universal Services Contract (USC) liner requirements as applicable. Over the next several weeks, further requests for industry input will be requested on the historical VISA contingency contract requirements to include relevancy of recommended liner T&C's from USC, how to best price the contingency contract, and preferences regarding Rate Methodologies (Revenue Based, Peacetime and Negotiated) for worldwide contingency application.
Please review the solicitation in its entirety and provide comments, concerns, issues and/or recommendations for consideration and discussion for the final RFP. In addition, we plan to host an industry day with all interested carriers to further discuss the VISA contingency contract, recommended changes and way forward. For planning purposes, we are targeting a day during the week of 8 December 2014.
Purpose:
VISA's purpose is to provide a responsive transition from peace to Contingency operations through pre-coordinated agreements for sealift capacity to support DOD Contingency requirements. VISA establishes procedures for the commitment of intermodal shipping services/systems to satisfy such requirements. Accordingly, the contingency contracts need to be renewed to keep current.
Background:
The VISA program is a partnership between the U.S. Government and the maritime industry to provide the DoD with "assured access" to commercial sealift and intermodal capacity to support the emergency deployment and sustainment of U.S. military forces. The VISA program was put in place and is owned by Department of Transportation's Maritime Administration (MARAD). The VISA program is authorized under the Maritime Administration's authorities under the Defense Production Act of 1950, and the Maritime Security Act of 2003, and was approved as a DOD commercial sealift readiness program on January 30, 1997. The VISA program provides for a time-phased activation of state-of-the-art commercial intermodal equipment to coincide with DOD requirements while minimizing disruption to U.S. commercial operations. MARAD recently extended the VISA program to October 2019.
The key component of VISA has been pre-negotiated contracts between DOD and VISA Participants, providing DOD assured access to commercial sealift capacity to meet national defense contingency or emergency requirements. As initially designed, three DOD contracts accomplished VISA Drytime Charter and Ocean Liner Distribution Service objectives: the VISA Enrollment Contract (VEC), the VISA Contingency Contract (VCC) and the Drytime Contingency Contract (DCC). Multiple DOD Components were involved in awarding and administering these multiple contracts. To participate, a company was required to execute multiple contracts (one DCC per vessel, one VCC per carrier) with multiple DOD Components. Reorganization within DOD placed responsibility for sealift contingency contracting in a single organization, USTRANSCOM.
Originally, the initial VISA liner vessel contracts were established in SDDC and charter vessel contracts were established in MSC. Both sets of contingency contracts were transferred to USTRANSCOM for adminstration in 2007 and 2011 respectively. On 1 Oct 2013, the charter and liner contingency contracts were extended and consolidated into a single USTRANSCOM agreement in which carriers agreed to a single contract identifying all vessels without any changes to the existing rates, terms and conditions. On 1 Oct 2014, the VISA contingency contracts were extended to 30 Sep 2015 for a 10th and final year of obligation and performance per statute.
Scope:
The scope of the renewed USTRANSCOM VISA Contingency Contract is to re-establish the combined VISA charter and liner requirements, update vessel capacity enrollment terms, add, remove and/or update current FAR, DFAR, and USTRANSCOM regulatory requirements, add, delete, and/or revise previous charter and liner terms and conditions to coincide with current and/or similar contract terms and conditions for existing contracted charter and liner services, and eliminate any redundancies.
In general, most of the VISA contingency contract revisions are minor. However, of interest is new Cyber Security and Facility Clearance requirements. In addition, prior to proceeding with a final VISA Request for Proposals (RFP), a meeting will be scheduled for industry to provide comments on the existing rate methodologies, recommend CLIN/rate structures on how best to price the contract as well as to provide an opportunity for an industry day to discuss recommended or revised liner and charter contract terms and conditions as detailed in the draft solicitation.
