This synopsis is issued in accordance with FAR 5.203(a). It does not constitute a solicitation and shall not be construed as a commitment by the Government to award a contract from this announcement.
The Naval Sea Systems Command (NAVSEA) intends to issue, on a sole source basis, a Request for Proposal (RFP) and award of a firm-fixed-price (FFP) contract to BAE Systems San Diego Ship Repair (BAE) under solicitation N00024-24-R-4423 for the execution of the USS HALSEY (DDG 97) FY24 and FY28 Depot Modernization Period (DMP) availabilities. A synopsis of solicitation N00024-24-R-4423 was previously published as competitive procurement. Upon BAE’s completion of both Chief of Naval Operations (CNO) Availabilities, the ship shall be capable of carrying out its respective mission with a reasonable expectation of maintaining a satisfactory condition of readiness until the next CNO-scheduled depot Availability.
NAVSEA intends to award the FY24 DMP using Other Than Full and Open Competition under the authority 10 U.S.C. 3204(a)(3), Industrial mobilization; engineering, developmental, or research capability; or expert services. In accordance with FAR 6.302-3(a)(2)(i), full and open competition need not be provided for when it is necessary to award the contract to a particular source or sources in order to maintain a facility, producer, manufacturer, or other supplier available for furnishing supplies or services in case of a national emergency or to achieve industrial mobilization.
NAVSEA intends to award the FY28 DMP using Other Than Full and Open Competition under authority 10 U.S.C. 3204(a)(1), only one responsible source.
FY24 USS HALSEY (DDG 97) DMP is scheduled to begin in September 2024 and complete approximately twenty-six months later (26) months later in November 2026. The anticipated scope of the procurement includes all labor, supervision, production, testing, and quality assurance necessary to prepare for and accomplish this CNO Availability.
FY28 USS HALSEY (DDG 97) DMP is tentatively scheduled to begin in September 2028 and complete approximately twenty-six months later (26) months later in November 2030. The anticipated scope of the procurement includes all labor, supervision, production, testing, and quality assurance necessary to prepare for and accomplish this CNO Availability.
Update #2 ·
The Naval Sea Systems Command (NAVSEA) intends to issue solicitation N00024-23-R-4423 for the execution of the USS HALSEY (DDG 97) FY24 Depot Modernization Period (DMP) availability. Upon a contractor’s completion of this Chief of Naval Operations (CNO) Availability, the ship shall be capable of carrying out its respective mission with a reasonable expectation of maintaining a satisfactory condition of readiness until the next CNO-scheduled depot Availability.
USS HALSEY (DDG 97) FY24 DMP will be approximately 26 months, beginning in September 2024 and completing in November 2026.
Pending additional authorities, the USS HALSEY (DDG 97) FY29 DMP may be awarded on a sole source basis to the successful offeror of the USS HALSEY (DDG 97) FY24 DMP.
If the Navy issues a solicitation for this CNO Availability, the Federal Acquisition Regulation (FAR), Defense Federal Acquisition Regulation Supplement (DFARS), and the Navy Marine Corps Acquisition Regulation Supplement (NMCARS) will guide the acquisition. The anticipated contract, like all other CNO-scheduled depot Availabilities, is a supply contract. The supply that would be procured is repaired, mission-ready ship, which shall be returned to service with the Fleet.
The anticipated scope of the procurement includes all labor, supervision, production, testing, and quality assurance necessary to prepare for and accomplish this CNO Availability. This CNO Availability is expected to require a highly capable contractor with substantial facilities, including dry dock pier and human resources capable of completing, coordinating and integrating multiple areas of ship maintenance, repair, and modernization of a DDG class ship.
The Competition in Contracting Act (CICA) requires that full and open competition be used to the maximum extent practicable. Under 10 USC § 8669a, competition for “short term” Availabilities (10 months or less) is limited to the homeport, provided there is adequate competition. Given that this Availability will be greater than 10 months in duration, the Navy intends to compete the acquisition on a coast–wide basis (West), without limiting the place of performance to the ship’s homeport.
The Navy will issue the solicitation electronically on https://piee.eb.mil and www.Sam.gov and interested parties must comply with that solicitation. Interested offerors are hereby encouraged to monitor https://piee.eb.mil and www.Sam.gov for the anticipated release of the solicitation, and any associated amendments. Offerors shall be registered in the Solicitation Module in Procurement Integrated Enterprise Environment (PIEE) and System for Award Management (SAM) to be eligible for award.
This synopsis is issued in accordance with FAR 5.203(a) and shall not be construed as a commitment by the Government to issue a solicitation or award a contract. The Government will not accept proposals as a result of this synopsis. The Government will not reimburse respondents for any questions submitted or information provided in response to this notice.
The Government anticipates issuing a Fixed Price Incentive Firm solicitation in March 2024.
In response to a resulting solicitation, all responsible sources may submit a proposal, which shall be considered by the Navy.
