The Department of Veterans Affairs (VA) is seeking quotes for Facility Maintenance Safety Training Services at the James A. Haley Veterans Hospital (JAHVH) in Tampa, Florida. The VA is procuring a variety of mandatory onsite training courses, including Arc Flash Certification, Aerial Lift Safety, Lock Out/Tag Out, Fall Protection, Ladder Safety, NFPA Fire and Smoke Door Inspection, Forklift, Bobcat, and Medical Gas Certification. The contract will be a firm-fixed price purchase order for a base year with four one-year option periods. Questions and Answers for RFQ# 36C24824Q1036
Specifically what level of fall protection training are you requesting. I see the class is a 3-day course, are you requesting the training be an EM385 Competent Fall Protection Person course? Is this class an Authorized Fall Protection Person course? Who are the students attending the training and what is their role within the organization, i.e., supervisors or end users? Does the training need to meet any specific requirements such as ANSI, or OSHA and finally are you requesting any specific experience level for the training organizations or third-party accreditation such as IACET?
Answer: Yes, the James A. Haley Veterans Hospital (JAHVH) Facility Management Services (FMS) Team is requesting BOTH the Competent Fall Protection Person Course (Refresher) and Authorized Fall Protection Person Course. Both these courses would fall under #4 Fall Protection General Industry / Course as described in the Performance Work Statement (PWS). All the shop personal within FMS will be attending the training, including supervisors. The Fall Protection Training needs to meet OSHA standards, therefore there is no specific experience level, if they are meeting the REQUIRED OSHA requirement to provide such certification and/or training.
Under Forklift and Bobcat training on the PWS, how many students is JAHVH requesting to attend this training?
Answer: Max 10 students per class.

COMBINED SYNOPSIS SOLICITATION
(i) This is a combined synopsis/solicitation for Facility Maintenance Safety Training Services at James A. Haley Veterans Hospital (JAHVH), as prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. A Firm-Fixed Price purchase order is anticipated.
(ii) The solicitation number is 36C24824Q1036 and is issued as a request for quotation (RFQ).
(iii) The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2024-04 (eff. 5/1/2024).
(iv) This procurement is set-aside based on an order of priority as established in 38 U.S.C. 8127.
The combined synopsis/solicitation is: 100% Set-Aside for Service-Disabled Veteran Owned Small Business (SDVOSB). The associated North American Industrial Classification System (NAICS) code for this requirement is NAICS Code 611430: Professional and Management Development Training code and has a size standard of $15 Million.
To be considered as a Service-Disabled Veteran Owned Small Business (SDVOSB), prospective offerors must be a verified SDVOSB on the U.S. Small Business Administration (SBA) Veteran Small Business Certification (VetCert) page (https://veterans.certify.sba.gov/) at the date and time set for receipt of offers.

(ix) The award will be based on a COMPARATIVE EVALUATION.
Award will be based upon a comparative evaluation of quotes in accordance with the Simplified Acquisition Procedures of FAR 13. Comparative evaluation is the side by side pairwise comparison of quotes based on factors resulting in a Contracting Officer decision for the quote most favorable to the Government.
Evaluations of Quotes:
The Government will select the quote that represents the best benefit to the Government at a price that can be determined reasonable.
The Government will evaluate the following: Price, Technical Approach (including training/certifications, Limitation of Subcontracting (LoS) Certification (SIGNED below), and New Vendor Form - Attachment 2), and past performance.
Contractors shall provide the following:
Technical Approach: Contractor shall provide a technical approach for Facility Maintenance Safety Training Services in accordance with (IAW) the PWS. Technical approach statement MUST be submitted separate from the price schedule/quote.
Training/Certifications: Contractor shall obtain all applicable training and applicable certifications to provide Facility Maintenance Safety Training Services as stated in the PWS.
Limitations of Subcontracting (LoS) Certification: Contractor must be able to comply with limitations on subcontracting clause in VAAR 852.219-75. Contractor MUST complete the Limitation of Subcontracting Certification (See VAAR 852.219-75 clause below) and submit with quote.
New Vendor Form: Contractor shall complete the New Vendor Form (Attachment 2).
Past Performance: Contractors submitting a quote shall be regularly established in the business of providing the services identified in the PWS and who have experience with commercial contracts of similar demand or greater, with conditions and scope as required for this contract.
Contractors submitting a quote shall provide three (3) identified references when submitting their quote. Emphasis will be on recent and relevant past performance. Recent is defined as work performed within the last three years. Relevant is defines as work similar in scope of the work described in the PWS.

Following receipt of quotes, the Government will perform a comparative evaluation of the services quoted. The Government will compare quotes to one another to select the service that best benefits the Government by fulfilling the requirement. The evaluation of Government requirements outlined in this request for quote will determine suitability.
Past performance evaluations will be conducted using information obtained from the Contractor Performance Assessment Reporting System (CPARS), and information from any other sources deemed appropriate. When evaluating past performance, the government will consider the currency and relevancy of the information, the source of the information, the context of the data, and the general trends in the contractor s performance. Quoters without available relevant past performance history will not be evaluated favorably or unfavorably. The Government reserves the right to obtain past performance information from other available sources.
The award will be made to the response most advantageous to the Government.
Responses should contain your best terms, conditions.
Information not contained in quotes will not be considered during the evaluation. The Government intends to make award selection without any follow up communication but may determine after evaluating submitted quotes that clarification may be necessary and conduct them as appropriate. The Government reserves the right to make no award if no quotes meet the requirements of this solicitation.
To facilitate the award process, all quotes must include a statement regarding the terms and conditions herein as follows:

VAAR 852.215-71 EVALUATION FACTOR COMMITMENTS (OCT 2019)
(a) The offeror agrees, if awarded a contract, to use the service-disabled veteran-owned small businesses (SDVOSBs) or veteran-owned small businesses (VOSBs) proposed as subcontractors in accordance with 852.215 70, Service-Disabled Veteran-Owned and Veteran-Owned Small Business Evaluation Factors, or to substitute one or more SDVOSBs or VOSBs for subcontract work of the same or similar value.
(b) Pursuant to 38 U.S.C. 8127(g), any business concern that is determined by VA to have willfully and intentionally misrepresented a company s SDVOSB/VOSB status is subject to debarment for a period of not less than five years. This includes the debarment of all principals in the business.

VAAR 852.219-75 VA NOTICE OF LIMITATIONS ON SUBCONTRACTING--CERTIFICATE OF COMPLIANCE FOR SERVICES AND CONSTRUCTION (NOV 2022)
(a) Pursuant to 38 U.S.C. 8127(k)(2), the offeror certifies that
(1) If awarded a contract (see FAR 2.101 definition), it will comply with the limitations on subcontracting requirement as provided in the solicitation and the resultant contract, as follows:
(i) [X] Services. In the case of a contract for services (except construction), the contractor will not pay more than 50% of the amount paid by the government to it to firms that are not VIP-listed SDVOSBs as set forth in 852.219 73 or VOSBs as set forth in 852.219 74. Any work that a similarly situated VIP-listed subcontractor further subcontracts will count towards the 50% subcontract amount that cannot be exceeded. Other direct costs may be excluded to the extent they are not the principal purpose of the acquisition and small business concerns do not provide the service as set forth in 13 CFR 125.6.
(ii) [] General construction. In the case of a contract for general construction, the contractor will not pay more than 85% of the amount paid by the government to it to firms that are not VIP-listed SDVOSBs as set forth in 852.219 73or VOSBs as set forth in 852.219 74. Any work that a similarly situated VIP-listed subcontractor further subcontracts will count towards the 85% subcontract amount that cannot be exceeded. Cost of materials are excluded and not considered to be subcontracted.
(iii) [] Special trade construction contractors. In the case of a contract for special trade contractors, the contractor will not pay more than 75% of the amount paid by the government to it to firms that are not VIP-listed SDVOSBs as set forth in 852.219 73 or VOSBs as set forth in 852.219 74. Any work that a similarly situated subcontractor further subcontracts will count towards the 75% subcontract amount that cannot be exceeded. Cost of materials are excluded and not considered to be subcontracted.
(2) The offeror acknowledges that this certification concerns a matter within the jurisdiction of an Agency of the United States. The offeror further acknowledges that this certification is subject to Title 18, United States Code, Section 1001, and, as such, a false, fictitious, or fraudulent certification may render the offeror subject to criminal, civil, or administrative penalties, including prosecution.
(3) If VA determines that an SDVOSB/ VOSB awarded a contract pursuant to 38 U.S.C. 8127 did not act in good faith, such SDVOSB/VOSB shall be subject to any or all the following:
(i) Referral to the VA Suspension and Debarment Committee.
(ii) A fine under section 16(g)(1) of the Small Business Act (15 U.S.C. 645(g)(1)); and
(iii) Prosecution for violating section 1001 of title 18.
(b) The offeror represents and understands that by submission of its offer and award of a contract it may be required to provide copies of documents or records to VA that VA may review to determine whether the offeror complied with the limitations on subcontracting requirement specified in the contract. Contracting officers may, at their discretion, require the contractor to demonstrate its compliance with the limitations on subcontracting at any time during performance and upon completion of a contract if the information regarding such compliance is not already available to the contracting officer. Evidence of compliance includes, but is not limited to, invoices, copies of subcontracts, or a list of the value of tasks performed.
(c) The offeror further agrees to cooperate fully and make available any documents or records as may be required to enable VA to determine compliance with the limitations on subcontracting requirement. The offeror understands that failure to provide documents as requested by VA may result in remedial action as the Government deems appropriate.
(d) Offeror completed certification/fill-in required. The formal certification must be completed, signed, and returned with the offeror s bid, quotation, or proposal. The Government will not consider offers for award from offerors that do not provide the certification, and all such responses will be deemed ineligible for evaluation and award.

VAAR 852.232-72 ELECTRONIC SUBMISSION OF PAYMENT REQUESTS (NOV 2018)
(a) Definitions. As used in this clause
(1) Contract financing payment has the meaning given in FAR 32.001.
(2) Designated agency office means the office designated by the purchase order, agreement, or contract to first receive and review invoices. This office can be contractually designated as the receiving entity. This office may be different from the office issuing the payment.
(3) Electronic form means an automated system transmitting information electronically according to the accepted electronic data transmission methods and formats identified in paragraph (c) of this clause. Facsimile, email, and scanned documents are not acceptable electronic forms for submission of payment requests.
(4) Invoice payment has the meaning given in FAR 32.001; and
(5) Payment request means any request for contract financing payment or invoice payment submitted by the contractor under this contract.
(b) Electronic payment requests. Except as provided in paragraph (e) of this clause, the contractor shall submit payment requests in electronic form. Purchases paid with a government-wide commercial purchase card are an electronic transaction for purposes of this rule, and therefore no additional electronic invoice submission is required.
(c) Data transmission. A contractor must ensure that the data transmission method and format are through one of the following:
(1) VA s Electronic Invoice Presentment and Payment System at the current website address provided in the contract.
(2) Any system that conforms to the X12 electronic data interchange (EDI) formats established by the Accredited Standards Center (ASC) and chartered by the American National Standards Institute (ANSI).
(d) Invoice requirements. Invoices shall comply with FAR 32.905.
(e) Exceptions. If, based on one of the circumstances in this paragraph (e), the Contracting Officer directs that payment requests be made by mail, the Contractor shall submit payment requests by mail through the United States Postal Service to the designated agency office. Submission of payment requests by mail may be required for
(1) Awards made to foreign vendors for work performed outside the United States.
(2) Classified contracts or purchases when electronic submission and processing of payment requests could compromise the safeguarding of classified or privacy information.
(3) Contracts awarded by contracting officers in the conduct of emergency operations, such as responses to national emergencies.
(4) Solicitations or contracts in which the designated agency office is a VA entity other than the VA Financial Services Center in Austin, Texas; or
(5) Solicitations or contracts in which the VA designated agency office does not have electronic invoicing capability as described above.

SUPPLEMENTAL INSURANCE REQUIREMENTS
 In accordance with FAR 28.307-2 and FAR 52.228-5, the following minimum coverage shall apply to this contract:
 (a) Workers' compensation and employer s liability: Contractors are required to comply with applicable Federal and State workers' compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with a Contractor's commercial operations that it would not be practical to require this coverage. Employer's liability coverage of at least $100,000 is required, except in States with exclusive or monopolistic funds that do not permit workers' compensation to be written by private carriers.
 (b) General Liability: $500,000.00 per occurrences.
 (c) Automobile liability: $200,000.00 per person; $500,000.00 per occurrence and $20,000.00 property damage.
 (d) The successful bidder must present to the Contracting Officer, prior to award, evidence of general liability insurance without any exclusionary clauses for asbestos that would void the general liability coverage.

52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)
The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only because of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within any time prior to expiration of the contract.

The Government may extend the term of this contract by written notice to the Contractor any time prior to expiration of the contract; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 15 days before the contract expires. The preliminary notice does not commit the Government to an extension.
(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed five (5) years.
