Justification and Approval

For

Other Than Full and Open Competition

1. Contracting Activity:

Department of Veterans Affairs, VISN 23

VA Black Hills HCS

Fort Meade Campus

113 Comanche Rd.

Fort Meade, SD 57741

This is a Justification for Other Than Full and Open Competition.

2237 - 618-14-3-6023-1823.

2. Nature and/or Description of the Action Being Processed: The Department of Veterans Affairs proposes to issue a new firm-fixed price contract to Minnesota Medical Specialists, 7177 Madison Avenue West, Golden Valley, MN 55427 (DUNS: 615990363) for the procurement of preventative maintenance and service support for two Tuttnauer Autoclave units located in Building 49 at the Minneapolis VAMC.

3. Description of Supplies/Services Required to Meet the Agency's Needs: The proposed acquisition is for preventative maintenance and service support for two Tuttnauer Autoclave units. The Tuttnauer autoclave sterilizers are required to have preventive services performed semi-annually by a qualified Technician, as stated in the Tuttnauer operations and maintenance manual. The estimated value for this requirement is $6,750.00 ($33,750.00 for base year and all option periods). Period of performance July 21, 2014 to July 20, 2015, with four, one year options.

4. Statutory Authority Permitting Other than Full and Open Competition:

(X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy

Agency Requirements per FAR 6.302-1;

( ) (2) Unusual and Compelling Urgency per FAR 6.302-2;

( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability

or Expert Services per FAR 6.302-3;

( ) (4) International Agreement per FAR 6.302-4

( ) (5) Authorized or Required by Statute FAR 6.302-5;

( ) (6) National Security per FAR 6.302-6;

( ) (7) Public Interest per FAR 6.302-7;

5. Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Tuttnauer USA Co has authorized service providers that provide sales and service for Tuttnauer equipment. These authorized providers are the only vendors that can provide service for Tuttnauer products. Minnesota Medical Specialists is the only service provider authorized by Tuttnauer in the Minneapolis market area (including the five surrounding states). Any service performed by a third party that has not been authorized by Tuttnauer can result in the termination of Tuttnauer's obligation to provide maintenance services or repairs to the equipment.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: No other suppliers were found for this requirement (see paragraph five (5) above). A notice will not be publicized for this procurement as it is under the threshold required under FAR 5.101(a)(1).

7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The anticipated price to the Government is $6,750.00 ($33,750.00 for base year and all option periods). Pricing will be reviewed and compared to pricing on previously contracted services that were found fair and reasonable and the IGCE.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research was performed to comply with Federal Acquisition Regulations and to ensure that VA receives the best value for this procurement. The Government conducted searches for other service providers on GSA schedules and the internet. This research indicated that Minnesota Medical Specialists is the only available source.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition: A previous Contract was awarded on a sole source basis to Minnesota Medical Specialists for annual service and maintenance under Order VA263-13-P-1763 on July 22, 2013.

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: See Section VI above.

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Market research was conducted, the details of which are in the market research section of this document. None of these efforts yielded additional sources capable of completing the Government's requirements. There is no competition anticipated for the proposed action. The Government will continue to conduct market research to ascertain if there are changes in the marketplace that would enable future actions to be competed. Should Tuttnauer train or supply other 3rd party vendors to enable them to support Tuttnauer equipment, they will be considered in the future.
