About this opportunity
The Food and Drug Administration (FDA) is seeking multiple Indefinite Delivery/Indefinite Quantity (IDIQ) contracts to conduct tobacco retailer inspections across five geographic regions in the United States. The solicitation aims to identify contractors who can perform undercover buy inspections and advertising/labeling inspections to ensure retailer compliance with federal tobacco laws, including age verification requirements. Contractors must provide program coordinators, FDA-commissioned inspectors, and underage purchasers (ages 16-20) to conduct comprehensive inspections in various locations. The original proposal deadline was February 4, 2025, though subsequent documentation indicates the solicitation was ultimately cancelled and reissued under a new solicitation number. Contractors will be responsible for maintaining detailed evidence, supporting FDA enforcement actions, providing monthly reports, and participating in agency training.
The solicitation is set aside for total small business participation and covers regions including the Northeast, Midwest, Southern states, and Puerto Rico. Contract performance is slated for September 30, 2025 through September 29, 2030, with guaranteed minimums of $10,000 per region and maximum values ranging from $5 million for Region 5 to $68 million for Region 3. The primary place of performance is Silver Spring, Maryland, though inspections will occur across multiple states and territories. For the Puerto Rico region, all personnel must be bilingual in English and Spanish. Pricing will include fixed price per inspection rates and labor hour rates for program management, with contractors expected to coordinate closely with FDA on enforcement follow-up and potentially provide witness testimony as needed.
