About this opportunity
The Department of the Navy Naval Sea Systems Command (NAVSEA) has issued a Special Notice for a sole source procurement related to the AN/ALQ-249(V)1 Next Generation Jammer - Mid Band (NGJ-MB) Basic Ordering Agreement (BOA). The notice announces a significant ceiling increase for the existing BOA, raising the total value from $56,670,000 to $99,968,000. Specifically, the procurement is targeted at acquiring Field Service Representative Support, Test Equipment, and additional Engineering Services for the NGJ-MB system. The sole source opportunity is exclusively directed at Raytheon Company, located in El Segundo, California, based on their unique proprietary data and system support capabilities. The procurement is being conducted under the authority of 10 U.S.C. 2304(c)(1) and Federal Acquisition Regulation 6.302-1(a)(2)(ii).
Contractors interested in this opportunity must be registered in the System for Award Management (SAM) and should be aware of several key details. The notice is informational and allows other sources to submit capability statements, though the government retains sole discretion in determining competitive procurement. The anticipated BOA modification is expected to be issued in August 2024, with the current ordering period end date remaining unchanged at December 3, 2025. The closing date for this notice is July 9, 2024, at 12:00 PM Eastern Time. Individual job orders will specify required tasks and delivery terms, and data deliverables will be in accordance with Contract Data Requirements Lists. Potential respondents are instructed to contact David Harrell at david.l.harrell38.civ@us.navy.mil with any questions, referencing the solicitation number. The government justifies the sole source approach by stating that utilizing another source would result in significant cost duplication and unacceptable delays in meeting agency requirements.

ITEM DESCRIPTION- Naval Surface Warfare Center (NSWC) Crane has a requirement for an increase to the BOA ceiling needed to procure Field Service Representative Support, Test Equipment, and additional Engineering Services of the AN/ALQ-249 NGJ-MB. The anticipated ceiling maximum of the BOA is estimated to be increased by $43,298,000 from $56,670,000 to $99,968,000. The ordering period end date of the BOA will remain unchanged at 03 December 2025. Individual Job Orders will specify required tasks and all applicable delivery terms and conditions. It is anticipated that the proposed BOA modification will be issued in August 2024. Data deliverables are in accordance with Contract Data Requirements Lists, DD 1423s.
SOLE SOURCE PROCUREMENT - The proposed contract action is for the services for which the Government intends to solicit and negotiate with one source, Raytheon Company, 2000 East El Segundo, CA 90245-3507 under the authority of 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1(a)(2)(ii), only one responsible source. The requirement is being solicited on a sole source basis because no other source than Raytheon Company has the proprietary data required to provide system support of the end items satisfying the agency's requirements. Utilizing another source would result in significant duplication of costs and unacceptable delays in fulfilling the agency's requirements.
All responsible sources may submit a capability statement or proposal which shall be considered by the agency. However, a determination by the Government not to compete this proposed contract based upon responses to this solicitation is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of re-evaluating the justification for sole source or limitation of sources and making a determination to change the acquisition strategy to a competitive procurement. A formal solicitation will not be posted to the SAM.gov website and is only available from the POC identified below.
Contractors must be properly registered in the System for Award Management (SAM). Offerors may obtain information on SAM registration and annual confirmation requirements by calling 1-866-606-8220 or via the internet at https://www.sam.gov.
