About this opportunity

The United States International Boundary and Water Commission (USIBWC) is seeking professional real estate services to acquire surface water rights from willing sellers within the Elephant Butte Irrigation District in Dona Ana County, New Mexico. The contractor will conduct comprehensive due diligence work including appraisal reviews, water rights validity confirmation, title investigations, landowner communication, document review, coordination with irrigation districts, and assistance with final agreements and closing processes. This acquisition supports the Rio Grande Canalization Project Environmental Water Transaction Program, which aims to acquire surface water rights to support up to 30 riparian habitat restoration sites. The contract will be evaluated using a best value/tradeoff methodology, considering technical understanding, federal acquisition experience, water rights expertise in Dona Ana County, key personnel qualifications, and proposed work plans. The proposal submission deadline has been extended to August 28, 2025, at 3:00 PM MDT, with responses to questions already posted as an attachment.

The solicitation indicates conflicting information regarding set-aside designation, with some sections referencing a 100% small business set-aside while others indicate full and open competition, though the NAICS code 531320 (Offices of Real Estate Appraisers) carries a small business standard of $9.5 million. The contractor must acquire a minimum of 15 parcels totaling 27.9 acres of surface water rights, with all work to be completed by September 30, 2027. Previous appraisal work was conducted by Joshua Cannon of Joshua Cannon & Associates with a review by Scott D. McDaniel of Keres Consulting Inc. The contract will be structured as a firm fixed price arrangement with potential hourly rates for additional curative work, and contractors should budget up to 10 hours for title curation per parcel. Performance will take place in El Paso, Texas, with the actual water rights acquisition activities occurring in the specified New Mexico counties.
