About this file

This document is a Questions and Responses file for FY254201010 Acquire Surface Water Rights, involving the U.S. International Boundary and Water Commission (USIBWC). The document addresses three key questions from a potential contractor regarding a surface water rights acquisition project in the Elephant Butte Irrigation District across Dona Ana and Sierra Counties, New Mexico. The first question confirms the original programmatic appraisal was completed by Joshua Cannon of Joshua Cannon & Associates, with a review by Scott D McDaniel of Keres Consulting Inc.

The subsequent questions focus on clarifying contract details, specifically addressing option tasks not initially included in the Contract Line Item Number (CLIN). USIBWC indicates they have conducted a generic programmatic appraisal for non-specific surface water rights and are currently updating it, preferring a broad appraisal that can be applied to multiple parcels. The document also requests the contractor to budget up to 10 hours for title curation per parcel and seeks clarification on the evaluation criteria structure, offering two potential approaches for the technical proposal submission.

FY254201010 Acquire Surface Water Rights Questions and Responses

1. In the Statement of Work document, it states that the Review appraiser shall be a different appraiser than that who conducted the appraisal.

Who completed the Programmatic Appraisal of IBID surface rights appraisal obtained by the Government?

NARRATIVE APPRAISAL REPORT, EBID SURFACE WATER RIGHTS, ELEPHANT BUTTE

IRRIGATION DISTRICT, DONA ANA & SIERRA COUNTIES, NEW MEXICO

Appraisal Project 27650, EFFECTIVE DATE, March 9, 2021, PREPARED BY Joshua Cannon, MAI, Joshua Cannon & Associates, Inc., PO Box 20088

Albuquerque New Mexico 87154

Review Appraiser Scott D McDaniel, Keres Consulting Inc.

2. It is our understanding that the option tasks are not included in the pricing provided in the CLIN. Please confirm.

If that is not correct,

• Under Option Task A, do you want us to budget for an updated appraisal for each parcel?

USIBWC has conducted a programmatic appraisal for non-specific surface water rights, and we are currently updating that appraisal. USIBWC anticipates that generic appraisal to be satisfactory. It is unknown what issues, if any, would render such an appraisal as insufficient. USIBWC prefers a non-specific, generic programmatic appraisal that can be used on any parcel of surface water rights within EBID, although a specific parcel appraisal could be warranted.

• Under Option Task B, please advise on how many hours to include for title curation for each parcel.

As this is an unknown, please put curation labor in hourly increments for staff required, up to 10 hours each parcel. Contractor is also free to comment on typical and atypical hours that could be needed for title curation issues that could arise, based on Contractor experience, if applicable.

3. Would you like us to follow the structure outlined in Section VI of the SOW (Evaluation Criteria) or that on the top of page 2 of the Clauses document? The latter only lists Technical Approach and Past Performance, while the former has 8 distinct sections.

Please address the SOW evaluation criteria to the best of your ability.
