Modification/Amendment 3:
The purpose of this amendment is to: 1) Revise the NAICS Code and provide the Product Service Code; 2) Update Attachment 4 with answers to questions submitted after 21 April 2106; 3) Revise Attachment 1 to reflect change to NAICS Code; 4) Revise the price list see Attachment 2, Rev-1 below. Note: The closing date of this solicitation was extended to May 6, 2016 in Ammendment 2, posted April 26, 2016.
Upon further review of the original NAICS Code (324110) it was determined that NAICS Code 325120 is more appropriate for this requirement as Propane is considered under the SBA Class Waiver List issued January 1, 2015, as Gases, Industrial (I.E., Compressed, Liquified, Solid), Manufacturing. The Non-Manufacturer rule allows a small business to offer a product that it did not manufacture under a small business set-aside if SBA has offered a waiver. The NAICS Code is hereby changed to 325120, Industrial Gases Manufacturing, with the Small Business Size Standard of 1,000 employees. The corresponding Product Service Code is: 6830.
Also, FAR 52.219-14, "Limitations on Subcontracting is applicable; however, FAR 52.219-14(c)(2) states: "Supplies (other than procurement from a nonmanufacturer of such supplies). The concern shall perform work for at least 50 percent of the cost of manufacturing the supplies, not including the cost of materials."
