About this opportunity
The U.S. Army Corps of Engineers Louisville District has issued a Special Notice for a Project Labor Agreement (PLA) Market Survey related to a large-scale construction project for an Army Reserve Center in Birmingham, Alabama. The notice is specifically designed to gather input from the construction community regarding the potential implementation of a Project Labor Agreement for this $35 million design/bid/build project. The proposed construction includes a 600-member Army Reserve Center with approximately 53,000 square feet of primary facilities, along with additional supporting infrastructure such as vehicle maintenance shops, equipment parks, and various site development elements. The project will incorporate sustainability measures, energy efficiencies, and meet Department of Defense facility criteria with a minimum 40-year design life. The solicitation number for this project is W912QR25R0020, and it is explicitly noted that this is a survey notice and not a request for proposals.
The primary objective of this Special Notice is to solicit comprehensive feedback from contractors regarding the potential use of a Project Labor Agreement (PLA) for the construction project. Contractors are invited to provide detailed responses to specific questions by 2:00 PM Eastern Standard Time on November 18, 2024, via email to Laura.Phillips-Payne@usace.army.mil. The survey seeks input on local PLA experiences, potential skilled labor shortages, scheduling requirements, and the potential economic and efficiency implications of implementing a PLA. Contractors are encouraged to provide both affirmative and negative perspectives, with the agency particularly interested in understanding potential barriers to competition and ways to improve the solicitation environment. The notice references Executive Order 13502, which encourages agencies to consider PLAs for large-scale construction projects, and highlights that the agreement would aim to promote labor-management stability, ensure regulatory compliance, and advance federal procurement interests. While there are no specific eligibility restrictions mentioned, the survey is open to construction industry stakeholders with relevant insights into the proposed project.

Federal Acquisition Regulation (FAR) Policy:
- FAR 22.502 requires agencies to use Project Labor Agreement (PLA) in large-scale construction projects to promote economy and efficiency in the administration and completion of Federal construction projects.
- An agency may, if appropriate, require that every contractor and subcontractor engaged in construction on the project agree, for that project, to negotiate or become a party to a project labor agreement with one or more labor organizations if the agency decides that the use of project labor agreements will:
- Advance the Federal Governments interest in achieving economy and efficiency in Federal procurement, producing labor-management stability, and ensuring compliance with laws and regulations governing safety and health, equal employment opportunity, labor and employment standards, and other matters; and
- Be consistent with law.

Provision: 52.222-33 Notice of Requirement for Project Labor Agreement
Clause: 52.222-34 Project Labor Agreement.
In consideration of the above factors, and any others which may be deemed appropriate, the construction community is invited to comment on the use of PLAs. Of particular interest to the Government are responses to the following questions:

- Are you aware of skilled labor shortages in the region for those crafts that will be needed to complete the referenced project? If so, please elaborate and provide supporting documentation where possible.
- Are you aware of time sensitive issues/scheduling requirements that would affect the rate at which the referenced project should be completed? If so, please elaborate and provide supporting documentation where possible.
- Identify specific reasons why or how you believe a PLA would advance the Federal Governments interest in achieving economy and efficiency in federal procurement.
- Identify specific reasons why you do not believe a PLA would advance the Federal Governments interest in achieving economy and efficiency in federal procurement.
- Identify any additional information you believe should be considered on the use of a PLA on the referenced project.
- Identify any additional information you believe should be considered on the non-use of a PLA on the referenced project.
*The Louisville District has seen a decrease in competition for solicited projects.
In addition to affirmative responses, we are seeking negative responses to identify any potential actions we may take to improve the competitive environment. Please provide a response with feedback including rationale for not wanting to submit a proposal and any recommendations that could promote interest.
* Please provide your comments via e-mail to Laura.Phillips-Payne@usace.army.mil no later than 2:00 PM Eastern Standard Time on 13 June 2025.
