About this opportunity
The Department of Health and Human Services, on behalf of the National Institutes of Health's National Eye Institute, has issued a Notice of Intent to award a sole source contract to Philips North America LLC for Philips Healthcare Intellivue MX500 monitoring systems. The contract will be for precision physiological monitors used in veterinary surgeries at the Bethesda, Maryland facility. This is specifically a notice of intent rather than a solicitation, meaning no formal request for quotations will be issued. The agency intends to award a firm-fixed-price contract to Philips North America LLC located in Cambridge, Massachusetts. The acquisition falls under the Laboratory Equipment and Supplies category with a Product Service Code of 6640.
The primary purpose of this notice is to inform the market of the agency's intention to proceed with a sole source procurement justified by the proprietary nature of the Philips monitoring systems and the need for consistency with existing equipment. The agency must receive capability statements from interested parties by September 26, 2025, submitted electronically to demonstrate they can provide the same or similar products and services. Only Philips can provide the necessary proprietary firmware, calibration protocols, and certified installation support required for these monitors, and using alternative suppliers would void warranties and compromise system reliability. The procurement is being conducted under FAR Part 13 Simplified Acquisition Procedures, which allows contracting officers to solicit from a single source when only one source is reasonably available. Interested contractors must demonstrate capability to provide equivalent monitoring systems that meet the same veterinary surgery requirements mandated by the Animal Care and Use Committee.

Description
This is a Notice of Intent, not a request for quotation. No solicitation will be issued, and no quotations will be requested.
The U.S. Department of Health and Human Services on behalf of the National Institute of Health (NIH), National Eye Institute (NEI), Briggs LSR intends to award a firm-fixed-price contract to Philips North America LLC, 222 Jacobs St, Cambridge, Massachusetts 02141 for precision physiological monitors used in veterinary surgeries.
Justification for Sole Source
The physiological monitoring systems by Philips are needed for monitoring animals during surgery, which is required by the ACUC. The lab currently has these Intellivue MX500 monitoring systems as well as other labs for consistency and continuity. Only Philips can provide the follow-on service and maintenance that these new monitoring systems will require because of proprietary data. Philips is the only source for the proprietary firmware, calibration protocols, and certified installation support necessary to maintain these monitors. Use of alternative suppliers would void warranties and could compromise system reliability and precision.
Authority
This acquisition is being conducted under the policies of FAR Part 13 – Simplified Acquisition Procedures, Subpart 13.106-1(b)(1). For purchases not exceeding the Simplified Acquisition Threshold (SAT), contracting officers may solicit from a single source if determined that only one source is reasonably available. Contracts awarded under FAR Part 13 are exempt from the requirements of FAR Part 6 (Competition Requirements).
Submission of Capability Statements
Interested parties capable of providing the same or similar products or services must submit a Capability Statement electronically. Responses will be considered solely for the purpose of determining whether to conduct a competitive procurement. A determination by the Government not to compete the proposed contract, based upon responses to this notice, is solely within the discretion of the Government.
