4. Authority and Supporting Rationale (See FAR 8.405.6(a) and, (b) and, if Applicable, a Demonstration of the Proposed Contractor's Unique Qualifications to Provide the Required Supply or Service:
X (1) An urgent and compelling need exists, and following the standard ordering procedures would result in unacceptable delays.
On March 4, 2019, the United States District Court for the District of Columbia issued a Memorandum Opinion and Order ("Order") vacating the decision of the Office of Management and Budget ("OMB") to stay and reconsider its 2016 Paperwork Reduction Act ("PRA") approval of the United States Equal Employment Opportunity Commission's ("the EEOC") revised EEO-1 information collection ("collection of Component 2 pay data"). The Order further provided that OMB's "previous approval" of the EEOC's collection of Component 2 pay data "shall be in effect." On April 25, 2019 the Court issued an Order requiring that the EEOC collect 2018 Component 2 data by September 30, 2019. This contract action is necessary to procure the services of an experienced survey research contractor to undertake and close all aspects of a collection of calendar year 2018 Component 2 data by September 30, 2019 to comply with the Court's April 25, 2019 order. The contractor will have extensive experience implementing all aspects of a national federal survey, utilizing survey methodologists, survey statisticians, survey program managers, data collection trainers, data scientists, and data security experts to provide in a very condensed amount of time and in an expedited manner all processes, procedures, and systems to undertake and close a collection of calendar year 2018 Component 2 data by September 30, 2019 in order to comply with the Court's April 25, 2019 order.
(2) Only one source is capable of responding due to the unique or specialized nature of the work;
(3) The new work is a logical follow-on to an original Federal Supply Schedule order, provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. the original order must not have been previously issued under sole source or limited source procedures; or
(4) The item is peculiar to one manufacturer.
5. A Determination by the Ordering Activity Contracting Officer That the Order Represents Best Value Consistent with FAR 8.404(d).
To comply with the court order efficiently and effectively, EEOC will utilize the Professional Services Schedule - Mission Oriented Business Integrated Services (MOBIS) Category 874.1.
6. Description of Market Research Conducted Among Schedule Holders and the Results or a Statement of the Reason Market Research Was Not Conducted:
Market research was not conducted. Given the court's order on April 25th, 2019, an urgent and compelling need exists and conducting market research would result in unacceptable delays.
7. Any Other Facts Supporting the Justification:
Please see attached copy of the April 25th, 2019 court order.
8. Statement of Actions, if Any, the Agency May Take to Remove or Overcome Any Barriers That Led to the Restricted Consideration Before Any Subsequent Acquisition for the Supplies or Services Is Made:
At the time the EEOC does not anticipate further court orders in this matter.
9. Approving Official's Determination Identifying Applicable Circumstance for Limiting the Source
Pursuant to FAR 8.405-6 (a)(1)(i)(A) it has been determined that an urgent and compelling need exists and following the GSA Schedule procedures would result in unacceptable delay.
