About this opportunity
The Securities and Exchange Commission intends to award a sole source contract modification to West Publishing Corporation for a CLEAR subscription API solution. The SEC requires a means to securely integrate proprietary data from its existing CLEAR Investigation system into internal applications to facilitate investigation workflows.
The SEC will use FAR 13.501(a) procedures to issue a fixed-price purchase order to West Publishing Corporation, as the Contracting Officer has determined they are the only source capable of meeting this requirement due to CLEAR system-to-system integration being the only known API solution for the proprietary CLEAR data. The anticipated base period is four months with three option periods of 12 months each. Interested parties can identify their capability by December 15, 2021, however a competitive solicitation will not be issued as this is a sole source award due to West Publishing Corporation being the only source meeting needs.

Notice for Sole Source Contract Modification:
The U.S. Securities and Exchange Commission (SEC) intends to use the procedures of FAR Part 13.501(a) to award a fixed price contract modification on a sole source basis to SEC Contract 50310220P0054 with West Publishing Corporation for CLEAR subscription components including The Delaware Corporate Gateway and CLEAR System-to-System connector. The CLEAR platform is the only subscription product identified that meets the SEC’s requirement. Other subscription products reviewed do not offer PenLink System-to-System Connector and it is critical that access to Delaware Secretary of State records and information for corporations be incorporated into SEC’s primary provider of corporate records information.
The contracting officer has determined that West Publishing Corporation is the only source that can reasonably meet the SEC’s requirement in accordance with FAR 13.501(a)(1)(ii) – Sole Source Acquisitions.
The period of performance for this modification is anticipated to align with Option Period III of the Contract for the Period of January 1, 2022 through December 31, 2022 and the subsequent Option Period (IV) which has a 12 month period of performance. The total estimated value of the contract shall remain below the dollar threshold in FAR 13.5 for the Test Program for Certain Commercial Items.
The SEC intends to award a contract modification to 50310220P0054 with West Publishing Corporation on or about December 16, 2021. This notice is not a request for competitive proposals. A competitive solicitation will not be issued. However, the government will give consideration to interested parties that identify their interest and capability to respond to the requirement by the response date of this notice.
Original Notice for Sole Source Contract:
The U.S. Securities and Exchange Commission (SEC) intends to use the procedures of FAR Part 13.501(a) to award a fixed-price purchase order on a sole source basis to West Publishing Corporation for an Application Programming Interface (API) web solution that provides secure integration of data from CLEAR Investigation system into SEC internal applications.
