About this opportunity

The Department of Homeland Security's Customs and Border Protection (CBP) has issued a Special Notice announcing its intent to enter into a sole source procurement for specialized laboratory equipment. The agency plans to acquire two Autopol 880 Plus Saccharimeters and accompanying Autoflex Automation Solution autosamplers exclusively from Rudolph Research Analytical of Hackettstown, New Jersey. This procurement is being conducted under the authority of 41 U.S.C. 3304(a) and FAR Subpart 6.302-1, which permits contracting with only one responsible source when no other supplies or services will satisfy agency requirements. The equipment will support CBP's Office of Acquisition in conjunction with CBP Operations Support and Laboratories and Scientific Services. The procurement falls under NAICS code 334516 for Analytical Laboratory Instrument Manufacturing and PSC category 6640 for Laboratory Equipment and Supplies.

The sole source justification stems from CBP's need for equipment that maintains complete compatibility with existing Rudolph Research Analytical laboratory equipment already in use by the agency. CBP emphasizes that compatible equipment is critical for ensuring consistent, repeatable, and accurate testing data and results necessary for trade enforcement activities. The agency has determined that no other manufacturer's equipment provides 100 percent compatibility with the existing Rudolph Autopol Saccharimeters and software systems. While this notice is not a request for competitive quotes and CBP has determined not to compete this contract action, the agency will consider capabilities statements from responsible sources that believe they can meet all requirements, which must be submitted by September 24, 2025. Rudolph Research Analytical remains the exclusive source for this proprietary equipment, including warranty, training, and repair services, with no authorized U.S. resellers available.

Notice text

Notice of intent to solicit and negotiate with only one source (Sole Source).

The U.S. Department of Homeland Security (DHS), Customs and Border Protection (CBP), Office of Acquisition, in support of CBP Operations Support (OS), Laboratories and Scientific Services (LSS), proposes to enter into a Purchase Order on the basis of other than full and open competition to acquire two (2) proprietary Autopol 880 Plus Saccharimeters and accompanying Autoflex Automation Solution autosamplers from:

Rudolph Research Analytical

55 Newburgh Road

Hackettstown, NJ 07840

UEI: TMSAT2W6ZLK9

The statutory authority permitting other than full and open competition is 41 U.S.C. 3304(a) implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1 entitled, "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements".

The required Autopol Saccharimeters must be totally compatible with the existing CBP-owned lab equipment from Rudolph Research Analytical. Use of compatible equipment is critical in order to ensure testing data and results remain consistent, repeatable, and accurate for CBP trade enforcement.  No other manufacturer’s equipment is 100 percent compatible with the Rudolph Autopol Saccharimeters and software already owned by CBP.   Rudolph Research Analytical is the only source for Rudolph equipment, warranty, training, and (if required) repair services.  There are no authorized U.S. resellers of this proprietary equipment or for its warranty, training, and maintenance services.

It has been determined, via this notice, and is in the Government’s sole discretion, not to compete this contract action.  This notice of intent is not a request for competitive quotes.  This synopsis does not constitute a solicitation, however all responsible sources that believe they can meet all of the requirements may submit a capabilities statement, which will be considered. Interested parties shall be required to provide a capabilities statement which would demonstrate how they can potentially meet the requirements described above.

The Government will review any submittals received in response to this notice prior to 12:00 pm Eastern Time on September 24, 2023.  All documentation must be submitted via email. Phone calls will not be accepted.  The Government will not be responsible for any costs incurred in the preparation of responses to this announcement. This is the only notice that will be issued for these items. A determination by the Government not to compete this proposed contract action based upon responses to this notice is solely within the discretion of the Government.

In accordance with FAR 6.305(a), a Justification as required by FAR 6.303-1, shall be made publicly available within 14-days post contract award.
