About this opportunity

The Department of Health and Human Services Indian Health Service has issued a Notice of Intent to Sole Source to TopRX for the procurement of Lentocilin, a critical medication used to treat syphilis. The Oklahoma City Area Indian Health Center intends to award a non-competitive contract valued at $211,200 for 14,080 doses at $15 per dose to address nationwide shortages of Bicillin L-A (penicillin G benzathine injectable suspension). The procurement is being conducted under FAR Part 6.302-1, which allows for sole source contracting when only one responsible source can provide the required supplies. TopRX is currently the only FDA-authorized supplier capable of temporarily importing Lentocilin while the primary product remains on production hold. The contract covers the 2025-2026 fiscal period and falls under NAICS code 325412 for Pharmaceutical Preparation Manufacturing.

The primary purpose of this sole source procurement is to ensure an adequate supply of medication to treat congenital syphilis patients and support mission-critical deployments combating syphilis outbreaks across Indian Country in the United States. This notice is not a request for competitive proposals, and no solicitation will be available for competitive quotes. However, potential respondents have until August 15, 2025, at 4:00 PM CST to submit written responses demonstrating clear and convincing evidence that competition would be advantageous to the government. The government reserves the right to use any non-proprietary technical information in future solicitations but is under no obligation to acknowledge receipt of responses or provide feedback. Any contractor wishing to challenge this sole source determination must provide compelling evidence of their capability to supply the required medication, though the government maintains full discretion in its final procurement decision.
