About this opportunity

The Special Notice from the United States Marine Corps announces its intent to sole source a bridge contract for management and mess hall attendant services at Marine Corps Base Hawaii to the incumbent contractor, Hawaii Department of Human Services. The justification and approval document attached to the notice cites 10 U.S.C. 2304(c)(1) and FAR 6.302-1 as the authority for this noncompetitive award due to a court order prohibiting the implementation of a competitive award made under a previous solicitation to any offeror other than the incumbent.

The Special Notice provides details of the planned sole source award including a one-year base period of performance from May 1, 2020 to April 30, 2021, a six-month option period, and potential six-month extension not to exceed two years total. The Marine Corps Regional Contracting Office previously competed this requirement among 8(a) small businesses but must now award sole source to Hawaii Department of Human Services under the court order pending arbitration from a protest of the competitive award. The notice instructs any questions regarding this procurement to be submitted in writing to the named contract specialist by the specified deadline.

Notice text

Prior to 1 May 2020, the Marine Corps Installations Pacific Regional Contracting Office - Hawaii ("RCO-Hawaii") intends to solicit and award a sole-source bridge contract under the authority of 10 U.S.C. 2304(c)(1), as set forth in FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.   Award will be to incumbent Hawaii Department of Human Services ("Ho'Opono"), the state licensing agency ("SLA") under the Randolph-Sheppard Act ("RSA").  The anticipated period of performance will be a one year base period from 1 May 2020 to 30 April 2021, a six-month option period from 1 May 2021 - 31 October 2021, and up to six months of service extension pursuant to FAR 52.217-8 from 1 November 2021 - 30 April 2022.  The maximum length, including all options and extensions, will be two years.

Services to be obtained are management and mess hall attendant  services ("M&MA") at Marine Corps Base Hawaii Anderson Hall and satellite dining facilities.  The award to Ho'Opono will set an 18% subcontracting goal.

RCO-Hawaii previously competed this requirement among 8(a) small businesses under RFP M00318-17-R-0003.  In accordance with the RSA, the SLA was also solicited.  Award was made to an 8(a) vendor, and the SLA invoked RSA arbitration.  RCO-Hawaii is enjoined by court order from implementing the competitive 8(a) award and must maintain Ho'Opono as its M&MA vendor pending final outcome of RSA arbitration or lifting of the preliminary injunction.  See attached justification and approval for additional information.

This notice of intent is NOT a request for proposals.  In accordance with DFARS PGI 206.302-1(d), RCO-Hawaii obtained an approved waiver from posting a request for information.   Evaluating capability statements from other vendors is not efficient or effective while RCO-Hawaii remains enjoined from awarding to other than Ho'Opono.

All questions regarding this procurement should be submitted in writing to contract specialist Erin Eslinger at erin.eslinger@usmc.mil.
