About this opportunity

The Commodity Futures Trading Commission (CFTC) has issued a Special Notice to sole-source the procurement of one Eikon License and one Refinitiv DataStream Web Service to the London Stock Exchange Group (LSEG), formerly known as Refinitiv. The CFTC intends to acquire these licenses under the authority of FAR 13.106-1(b)(1)(i), citing LSEG as the only reasonable source for the financial data critical to the agency's regulatory mission.

The purpose of this Special Notice is to inform interested parties of the CFTC's intent to award a sole-source purchase order to LSEG for a one-year base period with four one-year option periods. The CFTC is seeking written responses by August 8, 2024, at 12:00 pm ET, from any responsible sources that can demonstrate the capability to fulfill this requirement. However, this is not a request for competitive proposals, and the CFTC retains sole discretion in determining whether to compete this proposed requirement. The government will not be responsible for any costs associated with preparing responses to this announcement.

Notice text

The Commodity Futures Trading Commission ("CFTC") intends to negotiate and award a sole-source purchase order for the procurement of one (1) Eikon License and one (1) Refinitiv DataStream Web Service (DSWS).   The Government intends to procure this requirement under 41 U.S.C § 3304(a)(1), implemented by FAR 13.106-1(b)(1)(i) – “…only one source reasonably available.”

LSEG (formerly Refinitiv) is a unique source for financial data (data related to Refinitiv Instrument Codes used by Registrants for identifying equities and equity indices in Part 45 reporting) that is critical to the CFTC mission. The Refinitiv Eikon and Refinitiv DSWS will provide CFTC staff the ability to identify equity assets and indices underlying swaps in Part 45 reporting and analyze corresponding data such as index constituents.

Without access to this data, CFTC’s regulatory operations would be significantly impeded and there would be an increased risk to achieving CFTC’s mission.  LSEG is the only known source for these licenses and the CFTC is unaware of any alternative sources. CFTC intends to award a purchase order with a period of performance of a one (1) year base and four (4) – 1-year options.

THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS nor a solicitation of offers. However, the Government will consider written responses from all responsible sources received by 12:00pm ET, August 8, 2024. Written responses must include sufficient information to establish capability to fulfill the requirement. Oral communications are not acceptable in response to this notice. A determination by the government not to compete this proposed requirement is solely within the discretion of the Government. Information received will be considered solely for the purposes for future Market Research requirements. No formal solicitation package is available. The Government anticipates award on or about September 15, 2024. The Government will not be responsible for any costs of preparation in response to this announcement.
