About this opportunity
The Environmental Protection Agency (EPA) Region 4 has issued a Special Notice of Intent to Sole Source a contract for purchasing a new Agilent 8890/5977C (GC/MS) analysis instrument. The notice, posted on March 18, 2025, with a response deadline of April 18, 2025, outlines the agency's intention to award a fixed-price contract directly to Agilent Technologies, Inc. This procurement is specifically for the Laboratory Services and Applied Science Division (LSASD) to enhance their capabilities in performing volatile analysis of water and soil samples using multiple EPA methods. The contract will be executed using Simplified Acquisition Procedures and will not exceed the simplified acquisition threshold of $250,000.00. The EPA has determined that Agilent Technologies, Inc. is the only source capable of providing this specific instrumentation.
The primary objective of this sole source procurement is to acquire a GC/MS analytical system that is compatible with existing Agilent equipment at the EPA Region Laboratory. The agency justifies the sole source selection based on several factors, including the unique availability of the product from a single manufacturer, continuity of instrumentation, and the ease of maintenance and training for laboratory personnel. Contractors are not being solicited to compete for this opportunity, as the determination not to compete is within the government's discretion. Interested parties with questions or comments are instructed to contact the Contracting Officer, Megan Wallace, or Contract Specialist, Femi Obadina, via email, with the subject line "Notice of Intent Submission: Requisition PR-R4-25-00220". The EPA will not be responsible for any costs incurred by respondents, and any information received will be considered for potential competitive procurement assessments.
Notice text
This is a notice of intent, not a request for a quotation. A solicitation document will not be issued, and quotations will not be requested.
The Environmental Protection Agency (EPA) intends to award a fixed price contract on a sole source basis to Agilent Technologies, Inc. for the purchase of a new Agilent 8890/5977C (GC/MS) analysis instrument. The purpose of the procurement is to allow the Laboratory Services and Applied Science Division (LSASD) to perform Volatile analysis of water and soil samples using multiple EPA methods including 8260, 524 and 624. The GC/MS analytical system is instrumentation that should be compatible with other Agilent systems currently present at the EPA Region Laboratory.
This purchase will be made utilizing Simplified Acquisition Procedures in accordance with Federal Regulation (FAR) Part 13.106-1(b)(1) for purchases not exceeding the simplified acquisition threshold of $250,000.00. Pursuant to the authority granted by 41 U.S.C.253(c) (1), only one responsible source and no other supplies or services will satisfy agency requirements as implemented by FAR 6.302-1, the U.S. Environmental Protection Agency (EPA), Office of Mission Support’s Acquisition and Grants Management’s Branch intends to issue a purchase order to Agilent Technologies, Inc. for the purchase of a new Agilent 8890/5977C (GC/MS) analysis instrument.
The sole source nature of this requirement is based on the determination that Agilent Technologies, Inc. is the only organization that can provide this instrument. This system will allow LSASD to efficiently analyze and report Volatile samples for multiple methods including EPA methods 8260, 524 and 624. The products specified in this procurement are only available from one manufacturer. The continued use of products from this manufacture allows for ease of continued operation, as all current analysts have been thoroughly trained on the use and maintenance of Agilent equipment. Also, the use of Agilent equipment allows for ease of instrument maintenance and reduced downtime as parts are interchangeable between these and instruments currently in-house. Continuity of instrumentation will also allow for easier and quicker training of new employees as well as cross-training existing employees.
The determination not to compete this proposed contract action is solely within the discretion of the Government. Information received will normally be considered for the purposes of determining whether to conduct a competitive procurement. The Government will not be responsible for any costs incurred by responding to this notice.
Questions or comments to this Notice of Intent should be directed to the Contracting Officer, Megan Wallace, Wallace.megan@epa.gov and/or the Contract Specialist, Femi Obadina, Obadina.olufemi@epa.gov. Please indicate in the subject of your email: Notice of Intent Submission: Requisition PR-R4-25-00220.
