About this opportunity

The US Army Corps of Engineers, Walla Walla District has issued a Special Notice of Intent to award a sole source contract for trash and refuse services under FAR 6.302-1. The notice specifically pertains to monthly trash removal services across multiple counties in Washington, Oregon, and Idaho. The solicitation is focused on Sanitary Disposal Services Inc. as the sole provider, with the government determining that no other suppliers or services will satisfy their requirements. The contract will cover trash removal, including emptying and hauling containers for disposal from various government properties. The geographic scope includes Benton, Umatilla, Walla Walla, Franklin, Columbia, Garfield, Whitman, Clearwater, and Morrow counties across three states.

The primary objective of this Special Notice is to establish a sole source contract for waste collection services in rural and limited-resource areas where specific local providers are the only viable options. Interested parties may submit written responses identifying their capabilities by 8:00 AM Pacific Standard Time on March 14, 2025, to sara.edwards@usace.army.mil. The contract falls under NAICS code 562111 with a size standard of $12.5M, and responses will be evaluated solely to determine whether the procurement should proceed on a competitive basis. The government retains full discretion in making this determination, and no Request for Proposal (RFP) will be issued based on this notice. Eligibility is implicitly limited by the unique regional constraints, including state utility commission regulations and local franchise agreements that effectively restrict waste collection services to specific providers in each county. Oral communications are not acceptable, and contractors must carefully review the specific local regulatory environments that justify the sole source approach.

Notice text

NOTICE OF INTENT TO AWARD A SOLE SOURCE CONTRACT

US Army Corps of Engineers, Walla Walla District intends to solicit on a sole source basis under the authority of FAR 6.302-1 to Sanitary Disposal Services Inc.  Only one responsible source and no other supplies or services will satisfy agency requirements.

This requirement is to provide monthly trash removal services including emptying and hauling the trash from containers for disposal, in approved sites off of the Government property.  The areas to be serviced are located in Benton, Umatilla, Walla Walla, Franklin, Columbia, Garfield, Whitman, Clearwater and Marrow counties.

Washington

The Washington Utilities and Transportation Commission (UTC) regulates solid waste collection in Washington. Services are governed by Title 81.77 of the Revised Code of Washington (RCW) and Chapter 480-70 of the Washington Administrative Code (WAC). The UTC has granted Empire Disposal, Inc. authority to provide garbage and refuse services in relevant geographic portions of Columbia, Garfield, and Whitman counties. Empire Disposal is the only certificated carrier in that area. Similarly, the UTC has granted Basin Disposal, Inc. authority to provide garbage and refuse services in relevant geographic portions of Franklin and Walla Walla counties. Basin Disposal is likewise the only certificated carrier in that area. UTC Certifications are attached hereto.

Oregon

  1. 459A.085-459A.100 supports exclusive franchises for solid waste collection. Sanitary Disposal Inc. is the only sanitation company that provides garbage and refuse service in the Northern Umatilla and Eastern Morrow counties in the state of Oregon where the McNary Project is located. The McNary project has been a customer of Sanitary Disposal since its origin and has no other alternative for the scale of dumpster and drop box disposal service in the area.

Idaho

Dworshak Project is located in Clearwater County, Idaho, near the City of Orofino. This rural area (county population 8,500) is 50 miles from any greater population source (Lewiston, Idaho). There are limited local resources available to meet some commercial service requirements, including regular, routine non-hazardous waste collection and disposal.

Only one company exists in and serves Clearwater County communities. NADL Enterprises Inc. has regular garbage pickup routes on and around properties adjacent to Dworshak Project and Dworshak’s Dent Acres Campground, which is approximately 17 miles outside of downtown Orofino. NADL Enterprises Inc. is regulated by the Idaho State Department of Environmental Quality, North Central Health District, County Commissioners, and City Council. Therefore, another company cannot provide the needed refuse collection in this geographic region.

The North American Industry Classification System (NAICS) for this requirement is 562111 and the size standard is $12.5 M.  Interested persons may identify their interest, in writing, to the Government point of contact.  Responses to this notice must be received no later than 8:00 AM, Pacific Standard Time, March 14, 2025.  Such capabilities/qualifications will be evaluated solely for the purpose of determining whether or not to conduct this procurement on a competitive basis.  A determination by the government not to compete this proposed effort on a full and open competition basis, based upon responses to this notice, is solely within the discretion of the government.     Oral communications are not acceptable in response to this notice.  No RFP will be issued based upon this Notice of Intent.  Interested parties may submit any information for consideration by the government to: sara.edwards@usace.army.mil with Single Source Trash Refuse Services referenced in the subject line.
