About this opportunity
The National Park Service, Mount Rainier National Park, announced its intent to award a sole-source contract for solid waste hauling, disposal, and recycling services, with a response deadline of July 1, 2026 at 2:00 PM Pacific Time. The procurement is restricted to Harold LeMay Enterprises, Inc., doing business as Pierce County Refuse, which holds the exclusive state-regulated tariff (Tariff #12) for solid waste collection within Mount Rainier's boundaries under Washington state law.
The contract will be firm fixed-price, single-year, with an anticipated annual cost not to exceed $130,000. The sole-source justification rests on state regulatory exclusivity: Washington Administrative Code 480-70 restricts solid waste collection to certificated providers, and only LeMay holds the certificate of public convenience for Mount Rainier's service area. Federal law (42 U.S.C. 6961) requires the government to comply with state and local solid waste disposal laws as any private entity would, making competitive procurement infeasible. The National Park Service previously conducted a small-business set-aside solicitation to verify lack of competitive sources; no offers were received.
Interested parties may submit questions and comments by email to Contracting Officer Hal Hoversten at hal_hoversten@ios.doi.gov, including business name, qualifications, and point of contact, referencing solicitation number 140P8326Q0023. The Justification and Approval for Other Than Full and Open Competition is attached.
