About this opportunity
The National Institutes of Health (NIH) has published a Special Notice for the renewal of a maintenance agreement for laboratory equipment. The NIH intends to award a Firm-Fixed Price purchase order to LabLogic Systems, Inc. on a sole source basis to provide maintenance services for liquid scintillation counters used in the agency's analytical laboratory.
The purpose of this notice is to inform the public of the NIH's intent to renew the maintenance services contract with LabLogic Systems, Inc. due to the proprietary nature of the equipment and the requirement for a licensed service provider. The maintenance services are critical for the reliable operation of the laboratory equipment, which is governed by federal regulations. The Special Notice includes a deadline of September 4, 2024 for any other parties that believe they can fulfill the requirement to submit a written capability statement. The government will make a determination on whether to compete the proposed award based on any responses received. The notice specifies the eligibility criteria of holding a specific license issued by the U.S. Nuclear Regulatory Commission for the service of the liquid scintillation counters.
Notice text
The National Institutes of Health (NIH) intends to award a Firm-Fixed Price purchase order to Lablogic Systems, Inc. on a sole source basis.
In accordance with FAR Part 6.302-1, the Contractor is the only known responsible source who can provide the services for the requirement listed below.
The purpose of this notice is to inform the public that the NIH, Office of the Director, Office of Research Services intends to renew and purchase maintenance services to support the operation of laboratory equipment from Lablogic Systems, Inc. Only the manufacturer, LabLogic Systems, Inc., can provide the follow-on service and maintenance because of proprietary data. Routine maintenance for liquid scintillation counters (LSC) is critical due to the equipment’s internal radioactive standard. The instruments are governed by federal regulations issued by the U.S. Nuclear Regulatory Commission (NRC). The service provider must be able to satisfy the requirements for vendors specific in 10 CFR Part 32, Specific Domestic Licenses to Manufacturer or Transfer Certain Items Containing Byproduct Material. LabLogic possesses a specific license issued by the NRC for their service of the LSCs. ORS’ analytical laboratory is dependent on the reliable operation of its multiple Hidex LSCs, and given the complexity of the instruments, on licensed service personnel to provide maintenance. The manufacturer only sells directly and there are no resellers.
This notice is not a request for competitive quotes. However, any party that believes it can fulfill the requirement as stated herein and the requirements specific in 10 CFR Part 32, may submit a written capability statement that clearly supports and demonstrates the ability to satisfy the requirements. A determination by the Government to compete this proposed award based upon responses to this notice is solely within the discretion of the Government.
It is anticipated that an award will be issued approximately five (5) days after the date of this notice unless the Government determines that another company has the capability to satisfy this requirement.
Responses to this notice must have the notice ID #SS-NIH-7039526 in the subject line of the email. Please email responses to zetherine.gore@nih.gov no later than 12 p.m. EST on Wednesday, September 4, 2024.
