About this opportunity
The Department of the Navy Naval Facilities Engineering Command has awarded a sole-source contract modification to Tutor Perini Corporation-Nan Inc. A Joint Venture for emergency waterfront stabilization repairs at the Glass Breakwater at Apra Harbor, Guam, valued at $21 million.
The justification invokes 10 U.S.C. 3406(c)(1) for unusual and compelling urgency, as implemented by FAR 16.507-6(b)(1). Typhoon Bavi caused damage to the approximately 2.9-mile-long Glass Breakwater in July 2026, with approximately one-third of the structure classified as failed and two-thirds in intermediate damage condition. The modification, issued under existing contract N62742-22-D-1314, authorizes procurement and placement of approximately 27,000 tons of armor stone. The period of performance is not expected to exceed one year. The incumbent contractor TPC-NAN JV is already mobilized and best positioned to execute the work expeditiously; providing a fair opportunity would result in unacceptable delays that would jeopardize military readiness and logistics operations in the Indo-Pacific region. The Contracting Officer determined the anticipated cost fair and reasonable based on evaluation against an Independent Government Estimate and historically competitive rates. Future permanent restoration phases will be competed to the maximum extent practicable once site stabilization is complete. Place of performance is Apra Harbor, Guam. Work is funded through fiscal year 2026 appropriations.
Notice text
Justification for other than full and open competition for a sole-source contract modification to Tutor Perini Corporation-Nan Inc. A Joint Venture (TPC-NAN JV). This action is for critical and immediate emergency waterfront stabilization repairs to the Glass Breakwater at Apra Harbor, Guam, to address damage sustained from Typhoon Bavi and prevent further deterioration of this critical infrastructure. The modification, valued at $21,000,000, covers the procurement and placement of an additional 27,000 tons of armor stone. The statutory authority permitting this action is 10 U.S.C. § 3406(c) as implemented by FAR 16.507-6(b)(1); the agency's need for these services is of such unusual and compelling urgency that providing a fair opportunity would result in unacceptable delays.
Awarded contract N62742-22-D-1314 to unknown vendor for unknown amount on 2024-10-12.
