About this opportunity
The Department of Veterans Affairs Veterans Health Administration Veterans Integrated Service Network 9 has issued a Special Notice announcing an intent to sole source a 5-year Blanket Purchase Agreement for TEMPTRAK maintenance and service. The notice pertains to the VA Lexington Health Care System and its associated Community-Based Outpatient Clinics (CBOCs). Network Contracting Office 9 plans to award the contract directly to TrillaMed, LLC based on the vendor's exclusive distribution and service capabilities for the TEMPTRAKA system. The contract will be a Firm Fixed Price agreement, with the NAICS code 811210 and a size standard of $34.0 Million. The sole source justification is predicated on TrillaMed, LLC being the only source capable of providing the required supplies at the necessary quality level.
The primary purpose of this Special Notice is to inform potential contractors of the government's intent to award a non-competitive contract and provide an opportunity for other vendors to demonstrate comparable capabilities. Interested vendors can submit capability statements via email to Nicole McVey (Elyse.McVey@va.gov) by May 16, 2025, at 10:00 AM Central Time. To be eligible for consideration, contractors must be registered in the System for Award Management (SAM). The government retains full discretion to determine whether to proceed with competitive procurement based on the received capability statements. This notice is not a formal solicitation or request for competitive quotes, but rather an informative communication about the intended sole source procurement. The statutory authority for limiting competition is outlined under FAR 13.106-1(b)(2), which allows for sole sourcing when only one source can provide supplies at the required quality level.
Notice text
NOTICE OF INTENT TO SOLE SOURCE
In accordance with FAR 13.501(a), Network Contracting Office 9 hereby provides notice of intent to award a sole source Firm Fixed Price 5-year Blanket Purchase Agreement to TrillaMed, LLC. The basis for a sole source award is that the TEMPTRAK® system is solely distributed and serviced by TrillaMed, LLC. TEMPTRAK® is currently installed at all VA Lexington Health Care System campuses and Community-Based Outpatient Clinics (CBOCs).
The anticipated statutory authority for limiting competition is FAR 13.106-1(b)(2); only one source is capable of providing supplies required at the level of quality required because the supplies are unique or highly specialized. The NAICS code is 811210 with a size standard of $34.0 Million.
This Notice of Intent is not a solicitation nor is it a request for competitive quotes. However, any capability statements received by the closing date of this synopsis will be considered by the Government. A determination by the Government not to compete based on responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. Any prospective vendor must be registered in the System for Award Management (SAM) to be eligible for award.
Capability statements shall be submitted by email to Nicole McVey at Elyse.McVey@va.gov, and are due no later than May 16, 2025 at 10:00AM CT. Phone calls will not be accepted.
