About this opportunity
The U.S. Food and Drug Administration (FDA), under the Department of Health and Human Services, has issued a Notice of Intent to Sole Source a service agreement for maintenance and support of a Malvern Panalytical Axios Wavelength-Dispersive X-Ray Fluorescence (WD-XRF) spectrometer located at the FDA's facility in College Park, Maryland. This special notice, posted on February 4, 2026, represents the FDA's intention to award a sole source contract to Malvern Panalytical, Inc., the exclusive manufacturer and authorized service provider for this specialized laboratory equipment. The acquisition is justified under FAR 6.302-1, which permits sole source awards when only one responsible source can satisfy the agency's requirements. The FDA is providing other organizations until February 11, 2026, at 10:00 a.m. EST to submit evidence demonstrating their capacity to meet this requirement, with contract award anticipated within approximately fifteen days of the notice closing date.
The service agreement addresses the urgent need to restore maintenance support for the spectrometer, which has been without service support since September 13, 2025, and is critical to the FDA's Division of Color Certification and Color Technology in analyzing batch samples of color additives for compliance with federal regulations. Interested contractors must submit responses not exceeding 20 pages demonstrating technical experience with Malvern Panalytical equipment, capability to procure genuine replacement parts on an expedited timeline, and employment of manufacturer-certified engineers and technicians. The contract will provide comprehensive services including annual preventive maintenance, unlimited technical support with a 48-hour response time, on-site repairs within seven days, and unlimited software updates for a one-year base period with four optional one-year extensions through March 5, 2031. Eligible contractors must be capable of delivering all services at the specified FDA facility and coordinating with designated government project officers Kristen Reese and Corina McClure. Responses should be directed to Warren Jackson at warren.jackson@fda.hhs.gov by the February 11, 2026 deadline.
