The notice pertains to Request for Quote FDA-RFQ-25Q1285494 and indicates the agency's intention to award a fixed-price contract directly to Bruker, located in Billerica, Massachusetts. The FDA is utilizing the sole source authority under 41 USC 3304(a)(1) and FAR Subpart 6.302-1, which allows for non-competitive procurement when only one responsible source exists that can satisfy agency requirements. Bruker has provided documentation confirming it is the sole manufacturer and only authorized provider of maintenance and repair services for these specialized instruments.

The primary purpose of this notice is to inform potential contractors of the FDA's intent to proceed with a sole source acquisition while providing an opportunity for other parties to demonstrate their capabilities if they believe they can meet the stated requirements. Any organization that believes it can provide the required services must submit a written capability statement by 10:00 a.m. EST on August 14, 2025, to Warren Jackson at the FDA. Capability statements must clearly demonstrate the organization's ability to perform preventive maintenance and repair services for the Bruker Avance III equipment. The FDA maintains full discretion in determining whether to proceed with the sole source award or open the procurement to competition based on any responses received. If no qualifying alternatives are identified, the agency anticipates awarding the contract to Bruker within approximately fifteen days after the notice closing date.
