About this opportunity
The National Institute of Standards and Technology (NIST) has published a Special Notice regarding a sole source procurement of GriffEye Analyze License and CS Operations Client software from Magnet Forensics, LLC. This notice of intent, posted on February 26, 2026, indicates that NIST intends to negotiate a firm-fixed priced purchase order directly with the vendor rather than conduct a competitive solicitation. The procurement falls under NAICS code 513210 (Software Publishers) with a small business size standard of $47.0 Million. The contracting authority is based on FAR Subpart 13.106(b)(1), which permits the Contracting Officer to solicit from a single source. No solicitation document will be issued, and quotations will not be requested through this notice.
The primary objective is to renew NIST's annual software license for GriffEye Analyze and CS Operations Client, which the National Construction Safety Team (NCST) relies upon for investigating the partial collapse of the Champlain Towers South condominium building. The software provides forensic photo and video tagging capabilities critical to maintaining continuity of the investigation and evidence record keeping. The purchase order will cover a one-year base period with options for two additional years. The due date for this notice is March 5, 2026. NIST has determined sole source procurement is appropriate because switching to alternative software would jeopardize the clarity of evidence documentation and create significant investigative risks. This procurement is not available for competitive bidding; only Magnet Forensics, LLC is being approached for contract negotiation.
Notice text
Introduction
This is a notice of intent, not a request for a quotation. A solicitation document will not be issued, and quotations will not be requested.
Purpose
The National Institute of Standards and Technology (NIST) intend to negotiate a firm-fixed priced purchase order on a sole source basis with Magnet Forensics, LLC, located at 300 Colonial Center Pkwy Ste 130 Roswell, GA 30076. The purchase order will specifically procure GriffEye Analyze License and CS Operations Client software for a one-year base period with options for two additional years.
Authority
This acquisition is being conducted under the authority of FAR Subpart 13.106(b)(1) allowing the Contracting Officer (CO) to solicit from one source. The North American Industry Classification System (NAICS) code for this acquisition is 513210 – Software Publishers with a small business size standard of $47.0 Million.
Description
The NIST National Construction Safety Team (NCST) utilizes a license of the forensic photo and video tagging software, Magnet Forensics/GriffEye CS Operations and client, which is being used for the investigation of partial collapse of the Champlain Towers South condominium building. NCST currently holds an annual license for the use of this software and is in need of renewal services to continue the investigation of a partial collapse, which took place at the Champlain Towers South Condominium building.
Sole Source Determination
The sole source determination is based on the following:
GriffEye Analyze License and CS Operations Client software are a method of photographing and video tagging forensic evidence. NIST uses this software to support its investigation of the partial collapse which took place at the Champlain Towers South Condominium building. Continued access to this software is required for continuity of investigation activities for the remainder of the investigation. Use of another software would jeopardize clarity of evidence record keeping and create significant risks and delays in the investigation process.
Magnet/GriffEye individually develops and distributes this software and has no authorized resellers. Use of a different software solution would result in the duplication of efforts since the formatting within Magnet/GriffEye system is not compatible with any other programing. More so, NIST would incur unacceptable costs for extending the investigation beyond its originally proposed completion date. This includes lost of public trust and additional cost for travel, labor, and opportunity cost that would otherwise be saved if determined to remain on the current software. Magnet/GriffEye is therefore the only capable source.
